In the year 2019, approximately 56% of impaired driving incidents were cleared by charge, around 10% were let go without charge, and on the other hand 33% were not cleared. As compared to drug involving incidents alcohol cases were more likely to be cleared having the ratio of 57% to 49% respectively. Time required to clear the cases that involved drugs was about 1 month which was more than the time required to clear alcohol related incidents.

According to the reports, 77% of accused drivers for impaired driving were men of age between 20 to 34 years.

There are different offences of having specified prohibited levels of alcohol, cannabis or other drugs in blood stream within time of 2 hours while driving.

Penalties for the same include fines or life imprisonment depending on the offence.

Prohibited Blood alcohol level is 80mg or more per 100 ml of blood.

Having 2 nanograms and 5 nanograms of THC per ml of blood is less severe offence. If it is more than 5ng of cannabis then it is more severe offence.

For the offences that include alcohol , drug, or both alcohol and drug the 1st offence has mandatory minimum of $1000;for 2nd offence it is minimum of 30 days of imprisonment 120 days of imprisonment for 3rd offence. Maximum punishment in all of them is life time imprisonment.

If the individual refuses to agree for demand of sample then the punishment is $2000 fine.

If an individual has caused bodily harm the the indictment is of 14 years of imprisonment and if the harm is fatal then it could be life imprisonment.
