In most cases (if not all) Research Infrastructures are not "Research Performing Organisations" because their role is to support research (provide data, services etc) and not to perform research in the sense of investigating and answering research questions. The role of RIs is somewhere between the digital infrastructures (if those are at the level of data provision) and the researchers. Their practices (being FAIR and supporting OS) are of paramount importance for the research lifecycle. 

Regarding the first group of those who perform research, RI personnel might be technicians or scientists who are not classified as "Researchers". Not all data scientists, data stewards, data officers etc are covered by the term "Researcher", including scientists who work in other fields of the public sector, eg scientists working in education, communication, with local authorities etc. They don't necessarily perform research in the academic framework, but their practices should be Open and FAIR.
