We picked this video because it has the case details. This video explains the crime that Kyle Unger was wrongfully convicted of, on June 23rd, 1990 in a small town inside of Manitoba called Roseisle where at night 19-year-old Kyle Unger attended as well as 16-year-old Brigitte Grenier and 17-year-old Timothy Houlahan. They were attending a rock music festival at a nearby ski resort. Between midnight and 1:30AM Bridget was seen dancing, kissing, and fondling Timothy Houlahan. They set off together to a secluded part of the resort. Timothy was not seen after that again till approximately 4AM, where he was seen again covered in mud, scratches, and blood on his face. Timothy claimed he got his injuries from an attack from an unknown male who attacked him in the forest. Despite the attack that was claimed to happen Timothy still continued to party with his friends into the early morning. The following day Brigitte's body was found she suffered a terrible beating, bitten, struck several times in the head, strangled, and long sharp sticks were forced into her private parts. A key note to Kyle Unger being wrongfully convicted was that the police asked Timothy to describe Kyle Unger, he provided a description that was completely different than the description he gave of the attacker. This information however was IGNORGED by police. Timothy told police that Kyle Unger murdered Bridget and Kyle wanted Timothy to punch her a few times as well he refused, although he helped Kyle move her body in fear of his own safety. On October 23rd 2009, Manitoba’s deputy attorney general formally withdrew the charges against Kyle that he officially be acquitted.

We picked this article to display that when a person gets out of jai a new problem arises. On October 23rd, 2009 Kyle Unger was acquitted by the Manitoba Crown, although it was just the start of another problem for Kyle Unger that he would have to face after already facing 14 years in jail for a crime he didn’t commit. This new problem was trying to receive financial compensation for the time of his life he lost in jail for a crime he didn’t commit. on September 21, 2011, Kyle launched a civil lawsuit naming the RCMP officers and prosecutors who were involved in his wrongful conviction seeking $14.5 million in damages. Notably, one of the prosecutors in Kyle’s case, George Dangerfield, has also contributed to the wrongful convictions of at least three other people, Thomas Sophonow, James Driskell and Frank Ostrowski. So far both the Attorney General’s Office and the RCMP have refused to take any responsibility for Kyle’s wrongful conviction, instead maintaining that the damage he suffered was “caused or significantly contributed to by his own conduct, which includes, but is not limited to, his repeated admissions of having committed the offence for which he was convicted”. To this date Kyle Unger continues to fight for compensation.

Answering the Following Questions

1. Who are you completing the case study on?
We are doing the case study on Kyle Unger
2. Briefly summarize and explain the situation of your selected wrongly convicted person?
On Friday, June 22, 1990, nineteen-year-old Kyle Unger attended a rock music festival at a ski resort near his hometown of Roseisle, Manitoba. Brigitte Grenier, then sixteen years old and Timothy Houlahan also attended the festival. Between midnight and 1:30 a.m., Brigitte was observed dancing, kissing and fondling seventeen-year-old Timothy Houlahan. All three young people had attended the festival separately, with unrelated groups of friends. Neither Kyle nor Brigitte was friends with Timothy before the following day, Brigitte’s body was found lying in a creek in a heavily wooded area of the concert grounds. She had suffered a terrible beating: she had been bitten, struck several times in the head, and strangled, and long, sharp sticks had been forced into her private parts. The town of Roseisle was distraught and, correspondingly, the pressure on the police to solve the crime was overwhelming. In the following days Kyle Unger was charged with the murder of Brigitte Grenier, with the most substantial evidence coming from Timothy Houlahan as he said Kyle asked him to punch her a few times and he refused although he helped move her body with him because he was in fear of his own life.
3. Using Chapter 4 of your textbook (page 98), identify and explain how the factor(s) contributed to the wrongful conviction in your case. Tunnel Vison, a key note to Kyle Unger being wrongfully convicted was that the police asked Timothy to describe Kyle Unger, he provided a description that was completely different than the description he gave of the attacker. This information however was ignored by police. Also a false confession, Timothy confessed to the police that Kyle killed her and he wanted help with it. The flawed forensic and expert testimony, are case had flawed forensic because the hair sample that they had that they said belonged to Kyle was not actually his.
4. Was the wrongly convicted person awarded compensation for their situation? If so, how much? He did not receive any compensation for his situation but he is still in a legal battle in which he is trying to receive $14.5M from the government because he wasn't giving compensation.
5. In your opinion, should a wrongly convicted person be awarded compensation and comment on what you would determine is a satisfactory award (if any)? We think wrongly convicted people should get compensation because of the damages, they were In there for a long time and unable to make their own money. We would consider a satisfactory award of at least an average salary of just over $51 thousand as that is the average salary in Canada today.
6. What did you learn about the topic that surprised you/ The thing that surprised us the most was that the police had so much trust in Timothy's confession.
7.What are you most likely to remember from this research? We will mostly remember the fact that it is so easy to be wrongfully convicted of a crime as something as simple as one persons testimony.
