The court has ruled in favor of McCulloch. The bank of the United States is in fact constitutional and that the Maryland tax is unconstitutional. This is due to the Supremacy Clause of Article VI. Maryland was unconstitutionally undermining the superior laws of America. Not to mention as McCulloch said the Necessary and Proper Clause of Article I, Section 8 of the Constitution also supports the fact that the national bank is indeed constitutional.
