大致分類為以下內容

1.刑事責任

在網路散播假訊息、假新聞就刑事責任方面，可能構成刑法第310條毀謗罪、第309條公然侮辱罪、第151條恐嚇公眾罪、第153條煽惑他人犯罪或違背法令罪等。

2.民事責任

民法第195條第1項規定，不法侵害他人之身體、健康、名譽、自由、信用、隱私、貞操，或不法侵害其他人格法益而情節重大者，雖未對受害者造成金錢上的損害，但可請求賠償相當金額，名譽被侵害者可請求回復名譽之適當處分。

3.行政責任

散播謠言擾亂社會安寧者，可依社會秩序維護法第63條第1項第5款規定處3日以下拘留或新臺幣3萬元以下罰鍰。

4.法案可如何修正，加以預防假訊息

  1. 現在的假訊息已不再侷限於實體上，而是遍佈在生活各處，網路、實體都已經有非常多得假訊息出現，現在法規應要與時俱進，增加對於網路假訊息的相關法案，增強對於實體假訊息的相關處分及規範

  2. 對假訊息應要嚴格規定，規範要寫的更加明瞭，處分則應要時代的變更，假訊息的氾濫制定更適合此時代的處分

  3. 對假訊息要更嚴格的抓捕，而非因為氾濫則疏忽抓捕，這樣只會造成反面影響造成假訊息的氾濫愈演愈烈

我們發現，假訊息的流傳往往與人們的心理和資訊習慣有關。當一則內容符合我們原本的想法或立場時，我們更容易相信它並與他人分享。加上現代人依賴手機獲取資訊的習慣，使得每個人都可能成為訊息的「傳播者」。在這樣的環境下，真實與虛假的界線變得模糊，導致許多人在不知不覺中受到影響，甚至連自己都難以分辨。


我們之所以選擇以「假訊息」為探究主題，是因為它與我們的生活息息相關。無論是疫情期間的錯誤防疫資訊，或是社群上流傳的名人謠言，而周遭的親人，也時常轉傳錯誤資訊，成為假訊息的傳播者造成恐慌。這些都讓我們感受到假訊息的威力與危險。希望透過這次研究，深入了解假訊息的形成原因、傳播方式與該如何藉由教育及法律等，提高人們的媒體識讀能力，並學會查證訊息真偽。
