Women's suffrage was forgotten a bit when the civil war broke out and black rights were a large issue. Simmons case presented the checks and balances system fuctions in the USA. This happened on January 26, 2004 because there were many states that permitted the execution of juveniles. The Supreme Court ordered the judicial writ to evaluate if the eighth and fourteenth amendment protected a seventeen year old who had been found guilty of murder. The Supreme Court also decided to look over the Stanford v. Kentucky case that had many juvenile offenders commited. The Supreme Court had a 5-4 descision. The Constitution did not legalize the execution of sixteen and seventeen year old's. This was considered to be a cruel and unusual punishment. The National Supreme Court checked the States to make sure that they were following the constitution and the amendments. This represents the stable nature of the Constitution by showing that the National Supreme Court evaluated the Constitution and made sure it was followed. New York case demonstrated Federalism. This case began on February 23rd 1905. There were state laws in New York that banned bakeries to work more than 60 hours a week. This law was called the Bakershop Act and it was passed in 1895. Joseph Lochner who was a baker in New York, rebelled against this law stating that he was protected by the 14th Amendment to work how many hours he wanted. Lochner sued the State of New York for the violation of his personal civil liberties that were protected by the Constitution. This case went to the Supreme Court where they decided that the Bakershop Act was indeed a violation to the 14th Amendment. Also, the Supreme Court pronounced that the states do not have the power to control regulate jobs for people. This is only the power of the Federal Government. Nixon was asked to hand over the tapes, but he refused. He used the excuse of executive privilege which would keep him from revealing anything. He claimed this was to protect national security. Many people accused Nixon of hiding evidence by not releasing these tapes. The Supreme Court decided that he had to hand over the evidence and could not keep it because he had executive power. Many people have fought for this to be legalized but the way federalism is doesn't allow the states to make their own decisions about this.
