Anonymous, when you say rules do you mean the articles in the convention of Children's rights? Article 2 is a clear breach in this particular incident. Where is the respect and protection against discipline for the student when cutting their hair in a public display to enforce governance which would also clearly breach article 28.2: that all appropriate measures to ensure that school discipline is administered in a manner consistent with the child's human dignity.

I believe the principle has breached the Article 28 'Children have the right to an education.
Discipline in schools should respect children’s human dignity'. The principle should have taken other professional actions to handle the situation, for example: sending a letter home to the parents or having a meeting with them. To cut the students hair in front of his peers would highly affect his self-esteem and self-respect - Sara Qadir

I believe the deputy principle has breached elements of article 28 - 'Children the right to an education - parties agree to take appropriate measures to ensure discipline is administered in a way that maintains the child's human dignity' and also elements of article 29 - 'Parties agree education shall be directed to the development of respect for the child's parents'. I understand that the deputy principal was acting in line with the school rules, however the way he has enforced these school rules are in breach of the child's rights. As with most disciplinary practices there should have been warnings issued to the child with regards to his hair length. If those warnings were unsuccessful, than further action could have been taken by contacting the parents. It is ultimately the responsibility of the parents to then take their child to a hairdresser and arrange to have his haircut. By going behind the parents back, the deputy has disrespected them and also humiliated the child in the process. I do agree that discipline was necessary in this circumstance as their are rules in place, however there are fair ways to implement this discipline and cutting the child's hair in front of his peers was far from fair. - Maddison R

In relation to the UNCRC I believe the rights being violated relate to Article 28 which state that discipline within educational settings needs to respect children's human dignity, Article 16 which discuss the child's right to privacy which is breached by cutting his hair in a public place where people have access to recording devices, and also Article 12 to some extent as it seems that the decision to dismiss the deputy principle was done without consulting the students or families within the school and in particular being a secondary school it would be fair to say that the students would have valuable input into what is happening to their teaching team. While I do agree that the school rules that were agreed upon at the time of enrolment need to be adhered to, I don't believe the particular measure taken was the best response to the situation as it did not respect the students dignity. The same result may have been achieved by privately consulting the parents and discussing the issue. - Kate Conroy

The disciplinary act taken by the teacher clearly breaches article 28/2. Where appropriate measures should be taken to ensure that school discipline is administered in a manner consistent with the child's human dignity. I believe that this article has been breached as the hair cutting was a form of discipline. From the information that the online news article gave us this hair cut took place in a public setting at the school, therefore the students dignity could have been compromised by the manner in which this disciplinary act was administered. Article 3 also states that the best interests of the child should be a primary consideration. And you could argue that receiving the hair cut in the manner it was done was not in the best interest of the child.
I do believe that the students need to be following their schools rules and disciplinary actions should take place if these rules are breached. However, I do not believe that this is a fair form of discipline, even considering the established rules at the school. The online news article does state that the student whose hair was cut had already been asked on many occasions to trim his hair, obviously these verbal warnings weren't working. Perhaps the students parents should have been called/emailed about the hair issue so that they could rectify the issue prior to photo day. And if it wasn't rectified other steps could be taken e.g. student not participating in photos or being sent home with a parent to receive a haircut.
There are many different views that should considered when making decisions about discipline, these include the child, the parents, the school community and wider community.
- Felicity

Excellent comment Felicity especially your final statement that highlights the importance of all the contexts around the child when making decisions should be considered. There is always underlining issues that come to the surface when a final form of discipline is taken just like in the article that mentioned that the child had been asked repeatedly however we know from what children's rights are that the final action of the Deputy Principle was unacceptable and that a decision between the child, parents and the principle should of been made together and not in a public form of display as was done. Thanks for your participation Felicity I can see you really engaged with the topic. Cherie
