My professional perspective is working as a school guidance counselor at the middle school level. After finishing my master’s degree at Angelo State University and passing the Texas school counseling certification test, I will more than likely start my career as a guidance counselor at the elementary school level. After a couple of years, I hope to move up to the middle school level as a school counselor.

As I reviewed legal and ethical issues on the American School Counselor Association (ASCA) website, I noticed a lot of discussion over confidentiality, specifically regarding case notes. A great deal of time was spent discussing when notes are privileged and when they are not. The Family Educational Rights and Privacy Act (FERPA) was noted as a guiding source to help keep personal notes private (American School Counselor Association, n.d.).

Another issue that I encountered was legal obligations when a student threatens self-harm or suicide. School counselors are responsible for notifying parents when either is discussed (American School Counselor Association, n.d.).

As I reviewed the National School Boards Association, I saw a great deal of information about bullying. Information was given about anti-bullying state statutes. The majority of states even have statutes that apply to cyberbullying (National School Boards Association, n.d.).

I also found information about child abuse, specifically sexual abuse. Not only did the website address the fact that employees are obligated by law to report child abuse and neglect, it also talks about the importance of districts screening their own employees and conducting background checks on all staff to ensure child safety (National School Boards Association, 2016).

Summary

According to Gallo (2017), suicide is the second leading cause of death in the 14-24 year old age group. Boys and youth who identify as gay, lesbian, or transgender are the most at-risk to die by suicide. Other risk factors include a family history of suicide, depression, and drug abuse. Since approximately 90% of students contemplating suicide give warning signs, it is important for schools to implement suicide prevention programs. Programs should include training all school personnel about suicidal risk factors and what to do when they encounter a student talking about suicide ideation (Gallo, 2017).

According to Stone and Zirkel (2012), school counselors are usually the first people on campus to hear student outcries when it comes to suicide. However, many counselors are confused about their legal and ethical obligations. When it comes to suicide, past court cases can help counselors make decisions to help students. They can also help protect counselors as well. In Eisel vs. Board of Education of Montgomery County, a 13-year-old student died by suicide. Her parents sued the school district because they claimed the counselor did not inform them about her suicide ideation. This case highlights the importance of informing parents when students are at risk, even if that risk is low, of suicidal behavior. In Armijo vs. Wagon Mound Public Schools, the school district was found guilty because the school counselor drove a student home after he expressed a desire to die to an aide and knowingly left him alone at his house. The student later used a firearm and died by suicide. This particular case highlights the importance of staying with a student until a parent picks them up and gets them the help they need. If a parent is unwilling to get the student help, child protective services should be called (Stone & Zirkel, 2012).

As a school counselor, my job is to make sure all students are safe. I need to make sure that I take every suicidal threat seriously because failure to do so can have catastrophic consequences.
