Banks. Police all scramble to the house Rob R. Banks is supposedly hiding out at with the money he stole from the robbery. The police gain a "search warrant" from the court to search the house from the suspicion of him hiding there. Police break into the home with probable cause due to the anonymous tip of 35 Psycho Path. Police bust into the home to find Rob sitting on a couch with money all over the table. Once Rob is booked, Rob is told the charges against him. He does not have a small misdemeanor, he in fact has a felony which he was told this by his prosecutor of the case. Rob's bail is set at $250,000. At this point, arraignment is in place with Robs specific charges, and Rob is fighting as a not guilty plea. Rob has the right to counsel and hires a lawyer to his side. Rob still will not give up his partners in the crime. Rob knows this is hurting his case, but he will not budge. The prosecutor is urgent and offers something. He meets with Robs Attorney and offers a plea bargain. Rob is protected by the 5th amendment making him not have to testify in his own case, this would be self incrimination. Any witnesses that are testifying against Rob go through Rob's lawyer because due to the 6th amendment, he has the right to confront witnesses. The incorporation doctrine has been followed so far and continues to until the end of the jury trial. In order to make Rob a guilty verdict, The court and jury must see with evidence that Rob had not only mens rea, but also Actus reaus as well. The Grand jury rules there is evidence of these actions occurring within Robs case, giving the court enough evidence to more to a Petit Jury. Rob is not happy and appeals the decision saying that he had an unfair trial.
