         <description><![CDATA[<div>The supreme court was questioning  if the fifth amendment applied during police questioning. The supreme court voted 5-4 for Miranda because a persons rights should be informed to them before they are taken to court or into police custody. This case is important because it expanded the fifth amendment and introduced the Miranda rights. </div>]]></description>

         <description><![CDATA[<div>Melvin Smith was tried for illegal possession of a firearm which the judge ruled him not guilty because there was no evidence it was a real weapon and of its length. During the case a witness said it was a pistol which lead to the changing of the judges decision. </div>]]></description>

         <description><![CDATA[<div>The court was questioning whether or not it was double jeopardy because the judge ruled innocence then guilty. Supreme court ruled 5-4 for Smith because they said that the state didn't allow double jeopardy to occur.  </div>]]></description>

He got his case appealed because he said the jury was selected unconstitutionally. The new jury found him guilty of both charges, Benton then said that was double jeopardy </div>]]></description>
