There is no excuse for abuse. It was recorded by psychological professors in 2012 that mental health are neither necessary nor sufficient causes of violence, but it should be addressed that different opportunities be given to these people in regards to a recovery process e.g. the video watched yesterday displayed processes in which have helped to assist those suffering mental illnesses so they can return back to the community and make positive contributions to the functioning of society. There should not be altercations of sentencing, but there should be extra help provided. NO.

Reduce sentencing for mental health?

Yes, he offender is not at the right state of mind and with reducing the sentence it can agree with the just and equitable punishment but also can allow the offender to get the proper medication. The community's safety is important and the offender is apart of the community so the offenders mental stability is important as well. The theory of punishment (eye for an eye) supports the sentencing for the crime but reducing it will help deter the offender from re-offending.

A prominent aspect of a criminal conviction involves the mental element (mens rea). A normal person who completely understands the consequences of the crime should be held guilty of the crime as opposed to a mentally ill defendant. This defendant requires additional rehabilitation than a mentally stable human being. Imprisonment time could only make their mental health worse.

I believe that altering a sentencing due to a mental illness is most defiantly acceptable due to the serious mental problems that some people may go through and therefore further influencing the crime. For example, in yesterdays film one of the residents of the hospital said that he heard voices telling him to kill his father and if he didn't he believed something was going to happen as a result and therefore he killed his father.

As mens rea is an aspect of all crimes, it should be taken into consideration when deciding and altering sentences. However, it should not affect the sentence to the extent that it currently does as these people have still committed crimes and should be punished. Additionally, the courts must protect the community from these people, even if they are not in the right mindset while committing crimes.

I believe that it should only be decreased depending on the severity of the mental illness. If the person has schizophrenia they may not be too aware of the crime that they are committing, so with that I agree that they should be allowed to use that reasoning in court. With depression, I don't believe it is enough of a reason to be able to get less of a punishment as they are fully aware of the crime they will cause.
