Doe was a US Supreme Court decision that extended the right to attend free public school to undocumented children in the area where they live. This case began in Texas, where prior to this decision, local state statutes allowed only two options for undocumented children: (1) no education or (2) to allow the child to enroll, but the district would not receive the per diem funds for that student. The case arose when a school district decided to deny an undocumented child enrollment. Their children were in schools where traditional cultural values could be more easily taught, since the student population would be assumed as homogenous. The parents were concerned that with San Francisco deciding what schools students would be placed in to diversify the school district, rather than giving the parents a choice on what school they want
their children to go to.

As a result of this case, the Castañeda Standard was created which is a three part test to determine is schools are addressing the needs of their ELLs. These three prongs state that programs for ELLS must
(1) based on a sound educational theory, (2) implemented effectively with sufficient resources and personnel, and (3) evaluated to determine whether they are effective in helping students overcome language barriers.
