White students attended private schools, while black students either attended classes in churches, friends basements, or no education at all.

The private schools catered to white students only. The court ruled that because they closed the public schools to deny blacks an education, it was in direct violation of the Fourteenth Amendment. In addition, the court ordered that the public schools must re-open.

There were still schools in New Kent that 85% of the school population was black and other schools in which only a handful of the students were black. The green decision helped 
ensure racial balance.
