         <description><![CDATA[<div>Civil law: start with a clear legal code --&gt; when a case occurs, the judge simply applies the code. sometimes the judge must interpret the code to see how it applies in a particular case --&gt; very difficult cases go to a higher court. the higher court interprets the code and decides how it applies in the difficult case.<br>Common law: Start with a case decided on its merits --&gt; when a similar case occurs, the judge decides the case on its merits and in line with the precedent set by the first case --&gt; a huge body of case law develops with many precedents in slightly different cases <br>if when a NEW and DISSIMILAR case occurs, the legislature passes a statute that tidies up a complicated situation, or it may pass completely new laws --&gt; before applying a statute, a court may evaluate its constitutionality. this means that the courts may reject a statute and refuse to apply it. judges also have wide powers to interpret statutes; the court must decide what the statute means.</div>]]></description>
