The case originated with a lawsuit filed by the Brown family after their local public school district refused to enroll their daughter in the school that was closest to their home; instead, they required her to ride a bus to a blacks-only school, which was further away. At first, their district court appealed to the Board of Education for it didn't violate the 14th amendment, since they were "separate but equal". so, the Brown family went to the Supreme Court instead. 1951 - Topeka families tried to enroll their students in a “white school” so their children would have a shorter walk, all of which were denied based on skin color.

1951 - Lawsuit was filed against the Board of Education of the City of Topeka, Kansas in the United States District Court for the District of Kansas. 

December 1952 - Court appealed in favor of the Board of Education, stating that the 14th Amendment had no protection against segregation as long as both institutions were “separate but equal” .

December 1953 - The case was re-argued.

May 1954 - The Supreme Court issued a unanimous 9 to 0 decision in favor of the Brown family and the other plaintiffs. The decision consists of a single opinion written by Chief Justice Earl Warren, which all the justices joined.
