Since the founding of the Ku Klux Klan in 1868, the group has had a powerful influence in support of the democrat party in every southern state. More specifically, the Klan acted like a guerrilla military force in the sense that they violently spread racial domestic terrorism. With the motivation of restoring white supremacy, the acts of assaulting Black Republicans, destroying ballot boxes, giving death threats, and driving off former slaves from plantation fields were some of the ways in which the Klan asserted dominance in the South.

Racial and political terrorism continues to get more severe in Southern America. After a political success of the Republican Party in South Carolina, a white mob murders 13 Republican activists and drives another 150 African Americans out of their homes. Aside from regular Americans identifying as republicans, and African Americans, those in power politically and legally that weren't democrats are all forcibly reduced from their efforts as Klansmen even killed a Republican judge, 2 defendants in a court hearing a few months later.

In efforts of countering racial terrorism, Congress passed three Enforcement Acts. The intentions of the Acts were to make voting more secure as interfering with voting was established as a federal offense and supervision during voting was provided. Additionally, the Ku Klux Klan Act of April 1871 made violently infringing civil and political rights a federal crime punishable by the national government too. This led to the prosecution of hundreds of Klansmen in North Carolina and allowed for the restoration of law and order to a greater extent.

Civil Rights Act of 1875

This act outlawed racial discrimination in several public locations such as railroads, theaters, and hotels. Although this principle was established, there was poor pursuing of this law and poor federal intervention within Southern affairs. African Americans who wanted to take any cases to court had to wait in a expensive and lengthy process.

1883 Civil Rights Cases Decision

This decision of the Supreme Court declared the Civil Rights Act of 1875 as unconstitutional. The fourteenth amendment gave Congress the ability to only outlaw racial discrimination by states, not with private individuals. This was the last of efforts in this time period to protect the rights of African-Americans as the government no longer wanted laws exclusively for that demographic.

From the many acts of racially and politically motivated violence to the U.S. government's legal attempts in establishing law and order, these events show the lack of structure established by the government to support African Americans that were targeted by racial terrorism in several formats by the Ku Klux Klan, Democratic party, and pre-existing laws that were unfair.
