         <description><![CDATA[<p><strong>Why do you think your example qualifies as a tort?</strong></p><p><br/></p><p>I see this pile of building material as a child's oasis. When I was young these sites became our castles and forts which was amazing! This was one of the cleaner locations within the construction area currently in operation.</p><p><br/></p><p>There were no signs to alert you of potential harm from building supplies and open pits for house foundations or utilities. At night these areas would be more dangerous with no lighting in place.</p><p><br/></p><p><strong>What could be done to avoid a potential lawsuit?</strong></p><p><br/></p><p>Some possible solutions would be to place reflective signs around the holes and building supplies. Daily clean up should be conducted to lessen the possible dangers around these sites.</p><p><br/></p><p><strong>How does this change how you feel about public responsibility?</strong></p><p><br/></p><p>I believe we all have a part to play when it comes to safety.  Many times, we might not be aware of a danger because we have become accustomed to the dangers and see them as normal.  Workers and business owners are also focused on their jobs and might not be aware, feel it is their responsibility or care. It does help to have others bringing it to one's attention.</p>]]></description>

         <description><![CDATA[<p><strong>Why do you think your example qualifies as a tort?</strong></p><p><br/></p><p>I believe the Christmas decorations on the roof could have the possibility of being a tort and taking out one of Santa's elves, a small child or Grandma. We know that her and Santa have history when she got ran over by him and his sleigh many years ago.</p><p><br/></p><p>There is a potential for them to come loose from either the sandbags or snap from the strong winds which frequent this area.</p><p><br/></p><p><strong>What could be done to avoid a potential lawsuit?</strong></p><p><br/></p><p>A few items could be done to avoid potential lawsuits. 1 - post signs alerting individuals to the dangers above, 2 - place railing or netting at the edge of the roof over the entry or 3 - place them in the yard.</p><p><br/></p><p><strong>How does this change how you feel about public responsibility?</strong></p><p><br/></p><p>Like anything we can always overthink something to the point of ridiculousness. We do need to be aware of our items and remember to have fun and allow others to express their enjoyment with decorations in safe manners to the best possible manner known or available.</p>]]></description>

         <title>Defibrillator has not been replaced for more than 5 months</title>

         <description><![CDATA[<p>This example qualifies as a tort because the defibrillator is missing and if an emergency occurs, it could lead to serious harm or injury. The company failed to ensure that the defibrillator was restocked after it was used. This could be considered under negligence and even Breach of Duty for not ensuring safety to people at work. </p><p><br/></p><p>To avoid a potential lawsuit, the defibrillator needs to be restocked as soon as possible, have regular inspections and to ensure it is there and that it functions.</p><p><br/></p><p>This changes how I feel about public responsibility because it ensures the safety and well-being of others in public spaces.          <description><![CDATA[<p>This example qualifies as a tort under negligence as well. Similar to the defibrillator, items have not been updated and if someone is in need of an item that is expired or missing, it would cause greater consequences affecting the individual. This first aid kit needs to be ready for emergencies at all times. </p><p><br></p><p>To avoid a potential lawsuit the company must maintain a log of when the first aid kit is checked, what is missing, and what has been replaced. Having periodic inventory audits would help make sure the first aid kit is always up to date. </p><p><br></p><p>Public responsibility isn’t just about following legal requirements; it’s about maintaining a duty of care for others and ensuring that public safety resources, like first aid kits, are ready for use when needed.</p>]]></description>

The gate could be scaled by a young child.  The gate really should be higher and have a lock.  The owners are aware of the liability.</p><p><br/></p><p>An attractive nuisance is a tort law doctrine as it "enables the existence of a dangerous situation that appeals to children on their property," meaning that owners are responsible for any injuries sustained by a child, even if the child was trespassing. </p>]]></description>

         <description><![CDATA[<p>Our neighbor’s 7-year-old son put on a Fourth of July concert with fireworks in the background.&nbsp; This could have been a tort involving child endangerment, not only by his parents, who have the legal responsibility to care for the child’s safety and wellbeing, but by all of us watching.&nbsp; It could still be a tort even if the child didn't suffer any injury.  A child isn’t capable of determining if a situation is dangerous or not.&nbsp; That was our job.  It all happened fast, but one neighbor moved a bucket of water closer, but before it continued beyond 15 seconds, we were spared a potentially awkward situation of ending it before it continued because the child ended up running from the stage due to all the sparks and smoke from one particularly large firework.&nbsp; Fireworks could have been put at a distance, and the stage could have been enhanced by lights.  Perhaps when we feel unsettled about a situation, we would be well advised to listen to the Holy Ghost.</p>]]></description>
