         <title>1st Amendment </title>

         <description><![CDATA[<div>- Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.<br>-<strong><em>Morse v. Frederick: </em></strong>principal Deborah Morse suspended Joseph Frederick after he displayed a banner reading "BONG HiTS 4 JESUS" he then exercised his freedom of speech but was turned down to the fact that he was promoting drugs on school grounds.<br>- this basic right are very important to the people of america. these rights are what makes america...america, these principal rights are the reason we left Great Britain to form a country where a person is free to speak his mind, gather in protest, practice his or her religion, and do what makes them happy. these rights shape our nation and are deserving to be the first amendment in our constitution<br><br></div>]]></description>

         <description><![CDATA[<div>- A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.<br>- <strong>United States v. Cruikshank (1875)</strong>: The case arose during the Reconstruction Era from the 1872 Louisiana, was a conflict were an  armed militia of white Democrats attacked black Republican freedmen, were 105 African Americans were killed and only 3 white men killed. because of this outrage the black Republican freedmen used there right to bear arms to defend themselves from the angered white democrats.  <br>- i feel that this amendment is very important to out daily lives. people like to feel safe and by caring a side arm on them gives them a chance to defend them self in a life threatening situation. Guns dont kill people. people kill people. so i think the right to bear arms is very important to our rights</div>]]></description>

         <title>3rd Amendment </title>

         <description><![CDATA[<div>- No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.<br>-<strong><em>Engblom v. Carey: </em></strong>While the officers were on strike, some of their duties were performed by National Guardsmen. the employees on strike were&nbsp; evicted from employee housing which was then used to house some of the National Guard. then the employees filed a law suit on the guardsmen who were violating their rights.<br>-this amendment is beneficial to us because it means civilians dont get involve with military contact. this means that soldiers have to have there own housing which is provided and keeps them out of our homes. i like the ability that a person can allow a soldier to stay in his/her home but doesn't have to.</div>]]></description>

         <title>4th Amendment </title>

         <description><![CDATA[<div>- The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.<br>- <strong>Wilkes v. Wood (1763):</strong> John Wilkes was a member of parliament who printed anonymous pamphlets criticizing the King. The king issued a general warrant to find the creator of these pamphlets. Wood was charged with executing the warrant. The court ruled in favor of Wilkes<br>- i like the idea of a warrant has to be shown to be able to search another persons property. this means that a person can just be searched randomly. i think that this idea works because if someone has something illegal a cop can get a warrant and then search the person.</div>]]></description>

         <description><![CDATA[<div>- No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.<br>-<strong> Hurtado v. California, 110 U.S. 516 (1884):&nbsp;</strong>Joseph Hurtado discovered that his wife, Susie, was having an affair with their friend, José Antonio Estuardo. Joseph Hurtado attempted to put an end to this affair by sending his wife to her parents residence and dealing with Estuardo himself. after Hurtado was arrested for the murder of Estuardo he wasn't presented by a grand jury and was said to be a&nbsp; "Offenses heretofore required to be prosecuted by indictment, shall be prosecuted by information," but later he was presented by a grand jury that made it final that he was guilty.</div><div><br>- i like the idea that a person is to be prosecuted by a jury. it makes sense to me that a group of people should be a able to decide if you are guilty or not. because if it wasn't for the jury a person would be convicted by the capital or one single person, but with the jury you are prosecuted by the people that living this country.</div>]]></description>

         <description><![CDATA[<div>- In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the Assistance of Counsel for his defense.<br>-<strong>Gideon v. Wainwright:</strong><em> </em>Gideon was charged with breaking and entering with the intent to commit a misdemeanor, which is a felony under Florida law.&nbsp; At trial, Gideon appeared in court without an attorney.&nbsp; In open court, he asked the judge to appoint counsel for him because he could not afford an attorney.&nbsp; The trial judge denied Gideon’s request because Florida law only permitted appointment of counsel for poor defendants charged with capital offenses. he later filed that this had violated his rights.he&nbsp; filed a handwritten petition in the Supreme Court of the United States.&nbsp; The Court agreed to hear the case to resolve the question of whether the right to counsel guaranteed under the Sixth Amendment<br>- i feel that this amendment is beneficial to our daily lives and most importantly those who are convicted for trail. its fair that a person shouldn't have to sit in jail for a long time just to wait for his or her trail. ]I think its smart that a person should be given the right to a speedy trail.</div>]]></description>

         <description><![CDATA[<div>- In Suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury, shall be otherwise re-examined in any Court of the United States, than according to the rules of the common law.<br>- Krypton International Corporation, operate 3 television stations which ran various television shows licensed from Columbia Pictures after becoming for in dept Columbia took away his license to run the shows but he kept running them any ways Columbia pictures then sued him for $20,000 for each of the 440 acts, for a total of $8,800,000 in damages.<br>- i feel like this right is helpful in the way that it can settle disputes without senseless violence. but some people take this too far and figure they can sue others for every problem they have and that they can make easy money buy basically taking it from others. but without this amendment people would probably be killing each other over disputes</div>]]></description>

         <description><![CDATA[<div>- Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.<br>- <strong>United States v. </strong><strong><em>Bajakajian</em></strong><strong>:</strong><strong><em> </em></strong>&nbsp;Hosep Krikor&nbsp; <em>Bajakajian</em> went to Cyprus to pay his dept. he was put to trail because he did not specify the amount of money he had, and the law states that anyone leaving the country with more then 10,000$ must answer truthfully to how much he/she has. the judge ordered forfeiture of $15,000 in addition to the maximum fine of $5,000 and three years probation for failure to report. Bajakajian had been eligible for six months in prison, but the Judge did not impose this sentence. Hosep thought this punishment to be very disproportional to want the crime was<br>- I agree with the 8th amendment because it states that no person should be given excessive punishments or excessive bail. i think it would be obscured if a person charged with a speeding violation the be sentenced to death, or for a person who committed&nbsp; murder to be let go free of charge.</div>]]></description>

         <title>13th amendment</title>

         <description><![CDATA[<div>- Neither slavery nor involuntary servitude, except as a punishment for crime whereof the party shall have been duly convicted, shall exist within the United States, or any place subject to their jurisdiction.<br>- <strong>Hodges v. United States: </strong>Three White men had been convicted in the Eastern Arkansas District Court for conspiring against Black sawmill workers. The statute used to convict the men prohibits conspiracy to deprive American citizens of their Constitutional liberties, including the right to make contracts. The Supreme Court overturned the conviction, holding that Congress did not have the right to intervene against racially motivated interference with labor contracts.<br>- I very much agree with this amendment. i feel that slavery or and form of involuntary servitude is cruel and and should never exist. all people are created to be equal and everyone should be treated as such. that's why i very much agree with the 11th amendment</div>]]></description>

         <description><![CDATA[<div>- All persons born or naturalized in the United States and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.<br>- <strong><em>Hodges v. United States: </em></strong>Dred Scott, who was born a slave in Missouri, traveled with his master to the free territory of Illinois. Illinois being a free state he then sued his master for his freedom but the lower state court denied this he then went to the supreme court were because of the Fourteenth Amendment Dred Scott was granting citizenship  and all those born in the United States, regardless of color.<br>- i agree that people born in the united states should be considered  citizens of the US. without this amendment ethnic groups born into the country would not be considered citizens of the united states and our country would have such a diverse culture that it has today. </div>]]></description>
