         <description><![CDATA[<div>Link -<a href="https://kami.app/2PGyLi69ecsk"> https://kami.app/2PGyLi69ecsk</a><br><br>PRIOR WRITTEN NOTICE</div><div>IDEA requires prior written notice to parents whenever the district proposes or refuses to initiate or change the identification, evaluation, or educational placement</div><div>of a student (E.C. § 56500.4(a)). This notice creates a clear record of what, when, and why action was taken and can avoid future factual disputes between the parents and</div><div>the district. If written notice is not provided and a dispute leads to due process proceedings, it may be determined that the district denied the student a free and appropriate public education (FAPE) and must, therefore, provide such things as</div><div>reimbursement to parents for private services and attorney's fees.</div><div><br>Elements of the Written Notice</div><div>Legal mandates specify that the content of the written notice must include:</div><div><br></div><ol><li>A description of the action proposed or refused;</li><li>An explanation of the why the district proposes or refuses to take action;</li><li>A description of each assessment procedure, record, or report used as a basis for making the decision;</li><li>A description of other options the agency considered and why those options were rejected;</li><li>A description of other factors that are relevant to the decision; and</li><li>A statement of the availability of procedural safeguards and how to obtain a copy; and</li><li>Sources for parents to contact to obtain assistance in understanding the provisions of the law.</li></ol><div>(E.C. §56500.4(b)(1)-(7))<br><br></div><div>Written Offer of Educational Placement</div><div>When the action being proposed or denied is an educational placement, the descriptions provided in the written notice should include, but not be limited to, the</div><div>following specific information:<br><br></div><ol><li>Type of placement or service (e.g. specialized academic instruction, occupational therapy);</li><li>The school site where the placement or service is located;</li><li>Provider/Agency (e.g., special education teacher/PVUSD, physical therapist/CCS);</li><li>Names and qualifications of personnel, if relevant;</li><li>The daily schedule, if relevant;</li><li>Special equipment to be provided; and</li><li>Any other features of special relevance to the student such as class size, peer tutoring, socialization groups, etc.</li></ol><div>Providing the Notice</div><div>The notice may be given prior to or at the same time that the district requests the parents' consent to the action. Notice can be provided through any one or a combination of the following documents: on the IEP, in a separate written notice form, in a letter, and/or in any other clear written statement.<br><br></div><div>Multiple Offers</div><div>It is usually not recommended that the district offer more than one specific educational placement. Making a single offer gives the parents the benefit of professional judgment and demonstrates that the district has carefully thought through and selected a placement that will meet the unique and individual needs of the student.</div><div><br></div><div>CONSENT FOR IMPLEMENTATION OF THE IEP</div><div>Informed parental consent is required prior to initiation of initial special education services (E.C. § 56346(a)). If a parent refuses to provide such consent, the district</div><div>shall not be considered to be in violation of the requirement to provide FAPE (E.C. § 56346(b)) and shall not request a due process to override the lack of consent (OSEP letter to Fulfrost, 2004).</div><div><br><br></div>]]></description>
