Arson law deals with the burning of homes businesses, and other property or even forests. the crime of arson came long before our american legal system. arson laws have been enacted in all 50 states. there are many degrees of arson and those degrees are based on the factors of, if the building or property was occupied and if insurance fraud was intended.

First-degree arson – The act in which the arsonist sets fire to an occupied domain or building such as a school.

Second-degree arson – The act in which the arsonist sets fire to an unoccupied building such as an empty barn.

Third-degree arson – The act in which the arsonist sets fire to an abandoned building or an abandoned area of space such as a field.

Many states classify arson in different degrees. More serious degrees of arson will end in harsher punishments. A person may be sentenced to death if arson occurred as a method of homicide, as was the case in California of Raymond Lee Oyler and in Texas of Cameron Todd Willingham. and in Illinois aClass 1 felony (residential/house of worship arson) is punishable by a 4 to 15 year prison sentence. A Class X Felony like aggravated arson carries a mandatory prison sentence of 6 to 30 years in prison. In some cases, the sentence can be as high as 30 to 60 years.
