Ethical and legal constraints: Representation

Television and film should give a balanced display of representation in the media, as this allows all religions, ethnicities, genders and abilities to be showcased and represented equally. This allows audiences to connect with a person or a character and gives them somebody to relate to. The communications act 2003 states that Ofcom are required to promote equality of opportunity amongst broadcasters. They must look at gender balance, different ethnicities and abilities.

An example of negative female representation in the media comes in the form of washing up adverts. In the past, women were seen as housewives, required to stay at home and look after the kids whilst her husband was at work. This 1955 advert shows a stereotypical housewife washing the dishes and doing the laundry, all whilst her daughters watch. Most likely learning her traits. This is negative as it shows women as incapable of work and are good for few things, such as housework and child raising. This suggests that women are dependent on men and unable to think and act for themselves.

They are shown as strong, freethinking and able to make decisions themselves. This is positive as it reinforces the statement that women are just as strong as men and capable of the same, if not more. This representation allows the public to change their ways of thinking and see women as less of an object or a liability and more of a powerful figure with no limitations.

The race relations act was brought around in 1976 and simply meant that the media could not discriminate on the grounds of race, colour and nationality. This prevented discrimination and in a lot of ways also prevented racist content being shown on TV and in media. A negative example of race being used in the media is shown in a film called 'Attack the Block.' This film shows a group of youths, with a black leader, harassing a white woman while she walks home. This is negative as it reinforces the stereotypical view that black people are dangerous and should be feared within society. This gives no positive representation to black youths and instead shows them the way society still views them.

Copyright law is defined as a law that is put in place to protect people from getting their ideas copied or ripped off. Things that can be copyrighted include: ideas, footage, pictures, song lyrics and statistics. The benefits of this law are that: it protects the property of companies and protects profit which ultimately will lead to more investments in future products which will mean better quality. A lot of websites breach copyright law for broadcasting content which does not belong to them. Some examples of these sites include: movie shows such 123movies, or any other movie streaming site that allows you to watch movies for free. There are also a lot of music streaming sites that breach copyright laws as they allow you to download and stream music without purchasing it first. These breach copyright law as they do not have the permission of the company\label to share their work.

Tv shows and outlets have to be mindful of peoples privacy because everyone has the right to a private life, whether it's a celebrity or the public. This means that when covering a story, they cannot dig too far into somebody's personal life in order to create a story. Celebrities can ensure that their privacy is kept by getting something called a 'Super injunction.' This is a way of stopping the press from reporting on your private life. This will be granted by a court and is used to protect individuals.

Libel law was brought in to stop the media from damaging a persons reputation. A show that was accused of breaking libel law is the show 'Who is America?' Hosted by Sacha Baron Cohen, the show is currently being sued £72 million by Roy Moore for defamation. During the skit, Moore was portrayed as a sex offender, which in turn caused a lot of anger and upset. This is classed as breaking libel law as it ruined Moore's reputation and portrayed him in a negative way.

The Joanna Yeates case was accused of breaking libel law, as the media falsely accused Christopher Jeffries over her murder. He was the landlord of the building that Jo lived in and because of this, mixed with people saying he was 'strange' he was accused of her murder. Reports in papers were shown to be making him out as a monster and disregarded his privacy and rights. The media dug into his life and even went so far as to say that he was the associate of a convicted paedophile and even linked him to a murder from 1974. The media made him out to be an evil and disgusting man who had no respect for anybody's privacy, but this was far from the truth. It turned out that he was innocent and he has sued the papers for his false arrest. This included papers such as 'The sun, The Daily Mirror, The Sunday Mirror, The Daily Record, The Daily Express, The Daily Star and The Scotsman.' If he had been charged with the murder, the articles could have prevented him from having a fair trial as they were extremely slanderous to the point that his whole life was affected.

BBC Guidelines

Conflict of interest:
Conflict of interest is the ability to trust the BBC for TV shows and services. This impacts audiences as it allows them to be able to trust that they are not going to be lied to or deceived. They must ensure they are not influenced by outside parties and ensure that the TV shows are balanced. A show such as 'Newsnight' need to ensure that they are balanced and include both sides. For example if there was a political party involved, they must have an opposing side to ensure the show is balanced and both sides of an argument are raised.

Language:
The BBC must make careful judgements about their use of words. TV shows cannot show explicit language before 9pm. This also includes sexually explicit content. This allows audiences to not have to worry about inappropriate content being shown to children or using any language that they themselves may find offensive. Language would impact most shows as they all have to be cautious about the language they use and when they are shown. The overall decision is down to the producer.

Reporting statistics:
The BBC is responsible for avoiding using statistics at face value. They must ensure that all the statistics they use are accurate and if any are incorrect then they must correct them as soon as possible. This allows audiences to rely on the statistics they are seeing and make up their own minds and judgements. This impacts the news, as so many people rely on their stories and statistics, they must be correct.
