         <description><![CDATA[<p>According to American School Counselor Association (2022), school counselors are responsible for maintaining student confidentiality. The legal or ethical liability on the part of the school comes from a breach of confidentiality. In school counseling the risk of a confidentiality breach can occur when information about a student is shared with individuals not working directly with the student or without consent. When this happens, it makes the school district vulnerable to lawsuits alleging privacy violations. Risk management steps can be taken regarding confidentiality. </p><ul><li><p>Adequate training is an essential component of a confidentiality plan. School counselors must advocate for appropriate safeguards to keep student records private (American School Counselor Association, 2022). Proactively training school counselors on the importance of student confidentiality is one way school districts can protect themselves from legal action regarding student privacy. </p></li><li><p>Clear guidelines regarding the handling of confidential information must be developed and enforced. This is important to maintain security and accountability for all individuals responsible for secure information. </p></li><li><p>Audits should be conducted routinely to assess the effectiveness of the confidentiality procedures in place. Adjustments should be made when deficiencies are noted. This process ensures the established guidelines in place are functioning properly. </p></li></ul>]]></description>

         <description><![CDATA[<p>At the federal level, the governing agency is the U.S. Department of Education. This agency oversees programs related to education, including those involving school counselors. They are responsible for setting federal education policies. </p><p>School counselors in Texas operate under the jurisdiction of the Texas Education Agency (TEA). TEA is responsible for outlining educational guidelines and policies, including those for school counselors. School counselors support students in reaching academic and social-emotional goals (Texas Education Agency, n.d.). School counselors have the ethical responsibility to provide the utmost support to students from all backgrounds and to maintain confidentiality whenever possible (American School Counselors Association, 2022). School counselors must advocate for themselves and ensure they receive the professional development and support they need to effectively adhere to the standards outlined for them.          <description><![CDATA[<p>The Fourth Amendment to the United States Constitution significantly impacts the confidentiality of student records by protecting individuals from unreasonable searches and seizures which extends to personal records (U.S. Const. amend IV). </p><ul><li><p>Student information held by school counselors must be kept confidential unless there is consent given or a court order. </p></li><li><p>Students have a reasonable expectation of privacy of information at school.</p></li></ul><p><br></p><p>Article I Section 9 of the Texas Constitution guarantees individuals the right to privacy, including the disclosure of personal information without consent (Tex. Const. art. This expectation stems from the understanding that stringent guidelines are in place concerning confidentiality and cultural competence at the state and federal level offer comprehensive guidance for ethical behavior. State and federal guidelines, such as Family Educational Rights and Privacy Act (FERPA) govern confidentiality regarding student information (Federal Educational Rights and Privacy Act, 1974). The American School Counselors Association Code of Ethics outlines ethical practices for school counselors to follow regarding confidentiality and cultural competence (American School Counselors Association, 2022).</p>]]></description>

         <description><![CDATA[<p>The American School Counselor Association (ASCA) Ethical Standards states that school counselors recognize their primary ethical obligation for confidentiality of the the students but balance that obligation with an understanding of parents' legal rights to be the guiding voice in their children's lives (American School Counselor Association, 2022). This ethical standard emphasizes the need for student information to be kept private while understanding parent rights to information in order to make decisions for their child. This ethical standard is relevant to school counseling as there are times information shared during counseling sessions must be revealed to parents in the best interest of the child. By upholding this standard, school counselors can ensure a safe and trusting environment for the students and their families. </p>]]></description>
