- During the 1972 presidential campaign, five burglars with links to president Richard Nixon´s reelection campaign broke into Democratic head quarters at the Watergate complex in Washington, D.C. Over the next two years, the Nixon administration denied any involvement in what came to be known as the ¨water gate scandal.¨
- Archibald Cox, appointed to investigate the criminal aspects of the break in brought criminal charges against several of the Presidents highest ranking advisors, accusing them of conspiring to obstruct justice.
- President had secretly taped most of his telephone calls and the personal conversations in the Oval office.

1. Separation of powers does not mean that the three branches of government are absolutely independent of one another.
2. The Sixth Amendment guarantees a fair trial to all criminal defendants. If important evidence is withheld from a court, it will be impossible to conduct fair trails.
3. The protection of the secrecy of presidential communications is important, but that protection should be limited to a military and diplomatic matters.

1. In accord with the doctrine of separation of powers, no court has the authority to question a President´s claim of executive privilege.
2. The President must have the power to keep his various communications secret. Without that guarantee of confidentially, presidential aides would not speak as freely as they might, and the President´s decision-making ability would be harmed.
3. The forced disclosure of communications between the President and his advisors could pose a threat to the nation´s security.
