Throughout this unit, we've put in a lot of effort to comprehend and determine the correct tariff classifications for products within the section 5 to 7 while also familiarizing ourselves with the tariff and non-tariff regulations that surround them.

After comparing headings, conduct a subheading review, legally determining the tariff item.

Step 8: Inclusion of NICO

Add the Commercial Identification Number (NICO) to establish tariff classification.

Review explanatory notes and match your goods with tariff explanations to pinpoint the correct tariff item, acknowledging potential complexities.

Step 10: Final Verification

Verify the determined tariff item against regulations, ensuring accurate and compliant classification, recognizing occasional challenges in the process.

This rule states that products should be classified under the heading providing the most specific and appropriate description. If a product can be classified under both a more specific and a more general heading, the more specific classification is chosen.

General Rule 2 - Classification by Predominant Material

When a product consists of different materials, it is classified according to the material that gives it its essential character. If a product has parts made of different materials, it is classified based on the material that predominates in weight or value.

This rule states that when a product can be classified under two or more headings by applying the previous rules, it is classified according to the treatment it has undergone and its principal use. This especially applies to transformed or processed products.

General Rule 4 - Classification of Unfinished Products or Parts of Products

Unfinished products or parts of products are classified according to the material or product they are predominantly composed of unless they have a specific classification.

Containers and packaging are classified with the product they contain, unless they have a specific classification. However, certain types of containers can be classified separately.

General Rule 6 - Classification According to the Principal Purpose

When an article has multiple uses, it is classified according to its principal function or use. This applies especially to tools and utensils that may have various uses but are classified based on their principal use.

Usage Methods:

1. Passenger Way:

   • Eliminates the need for a customs agent.

   • Merchants can directly present the goods to the customs authority of the SAT.

   • Self-validation and sealing of the ATA Carnet.

   • Ensures smooth customs passage without incurring import duties or taxes.

2. Freight Way:

   • Suitable for cargo transported by plane or ship, especially for sizable volumes.

   • Recommends the use of a customs agent for efficient handling.

   • The agent can act as a manager and dispatcher before customs.

   • Similar to the Passenger way, it streamlines processes and saves time.

• Non-Tariff Regulations and Restrictions:

  • The ATA Carnet does not exempt compliance with non-tariff regulations and restrictions in the destination country.

  • Environmental, safety, and health permits may be required, and merchants should consult with a Customs Agent to ensure adherence.

• Limitations:

  • The ATA Carnet is not intended for final exports.

  • Does not cover the transport of certain goods, including food, liquids, chemicals, paints, perishables, disposables, or items that are challenging to identify.

Merchants should engage with a Customs Agent to determine specific tariff fractions for their products and verify if any regulations apply, ensuring a smooth and compliant temporary admission process with the ATA Carnet.
