A unanimous court found that tech giants Twitter, Facebook and Google were not liable for the decision, the leaders of the Islamic State group are keeping their platforms under federal anti-terrorism law.

The case comes after Jordanian citizen Nawrath Alasaf and 38 others were killed in a 2017 Istanbul nightclub shooting. Alasaf’s family alleged that the social media companies created and abet the Islamic State group by helping it spread its message by using computer algorithms to suggest user-generated content based on their browsing history. The court found that such alleged conduct did not constitute aiding and abetting terrorism under federal law.

Littleton required adult businesses to apply for a permit to operate in the city. If the city denied the license, the company could appeal to a state district court under the Colorado Rules of Civil Procedure. Z.J. Gifts, an adult bookstore, wanted to operate in a location not designated for adult businesses. Instead of applying for a license, they challenged the licensing law itself as unconstitutional, arguing that the Colorado Rules of Civil Procedure only provide for a speedy judicial review of a city’s denial, not a speedy trial. Since stores denied a license cannot operate until the court issues a decision, they could potentially be forced to wait indefinitely for a license based solely on the content of the material they intend to sell. This, Z.J. argued, violates the Supreme Court’s ruling in Freedman v. Maryland, 380 U.S. 51, that censorship laws must provide for “speedy judicial determination.” A federal district court sided with Littleton. A panel of the Tenth Circuit Court of Appeals overturned the ruling. (Mar 24, 2004)

Media lawyers are bracing for an onslaught of lawsuits from Donald Trump and his political allies over ABC’s decision to pay $16 million to settle a libel case Trump filed against the network.

Many First Amendment advocates see the settlement as a capitulation by ABC that gives Trump both a lucrative victory and a legal road map. They fear it will embolden him to step up his use of private civil suits against his media critics when he returns to power next month.
