Some hospitals were overrun with patients and had to set up hospital wards under tents and at convention centers for the overflow patients. COVID-19 overran some skilled nursing homes, resulting in a large number of patients and workers testing positive. This was especially true during the early days when public health officials did not know much about the disease or how it was transmitted. Some states passed legislation protecting the facilities unless they were guilty of “gross negligence” or “willful misconduct.” Some legislation only protects the facilities from suit if the patient had COVID-19. Other legislation protects the facilities if the patient’s care was affected by COVID-19.
