El Estado es responsable de garantizar este derecho y tiene la facultad de regular y supervisar el sistema educativo nacional. Además, se reconoce el derecho de los padres a elegir el tipo de educación que desean para sus hijos, siempre y cuando se cumplan los estándares mínimos establecidos por las autoridades educativas. Este artículo también establece la obligación de los maestros de contar con la idoneidad necesaria para ejercer su profesión y promueve la formación continua de los docentes.
