Everything published on the internet is protected by copyright law!

There are eight categories of copyright protection:

• Literary works

• Musical Works including accompanying words

• Dramatic works including accompanying words

• Pantomimes and Choreographic works

• Pictorial, Graphic, and Sculptural works

• Motion pictures/Audiovisual works

• Sound Recordings

• Architectural works

Where there are many things that copyright protects, there are also categories where copyright law does not apply. These include:

• Ideas

• Procedures/Processes

• Methods of Operations

• Principles

• Titles/Names

• Short Phrases

• Recipes

If fair use is to apply to your situation, there are four factors to consider:

• Purpose and Character of use- For what or why are you using this work. If it is for research or teaching, fair use may apply. However, if it is for parody or commercial use, it may not.

• The Nature of the Copyrighted- This factor looks at what type of work are you copying. I will consider whether it is fiction or nonfiction and whether it is published or unpublished. Nonfiction published work is more likely to fall under fair use.

• The Amount of Sustainability and Portion used- This considers the percentage you are using in relation to the entire work. Using a small portion or one of little relevance to the entirety of the work is more likely to fall under fair use.

• Effect of use on Potential Market- This considers how your use affects the market of the work in relation to the owner. If your work takes away profit from the owner, it is likely not going to fall under fair use.

There are four different conditions that could be applied when obtaining a creative common.

• Attribution - This is required on all creative common license. It states the person using your work must give you credit in the way you request. If they do not want to, they must get permission before using the work.

• Non-Commercial - This allows others to copy, distribute, display, and modify your work for reasons that are not commercial.

• No Derivatives - This allows other to copy, distribute, display, and preform your work but only as the original copy. It may not be modified.

In addition to these conditions, there is also a Creative Commons Public Domain Dedication. This allows authors to give up their copyright and make their work public domain. This means others may copy, distribute, display, preform, or modify the authors work with no conditions applied.

When creating lesson plans in the future and finding the materials for my lessons, I will think back to this and how I can be thoughtful when choosing my works for the classroom. It is something that seems so small, but can impact you if you are not careful, especially if you happen to teach a remote class.

Moving forward, this will not only be knowledge I use when I am a teacher in the future, but also as I am a student. I can begin practicing now when I am searching for materials for projects. These skills can then be used later on as I move into my career. These are things I have not thought of before, but I can now use in my current job at my school and in the future.

There are guidelines that have to be followed in order for this to apply. This includes:

• The work being for instructional purposes.

• The work being included in an in-person lesson. Online lessons are not applicable.

• Must take place at a non-profit educational institution.

The TEACH Act stands for The Technology, Education, and Copyright Harmonization Act. This States that teachers and students at accredited institutions may use works without permission if they are used for distance learning.

There are criteria that need to be met before this applies:

• Must be an educator at an accredited institution.

• You must supervise your students use of the copyrighted work.

• You are using the material as an integral part of the curriculum and lesson.

• The work must relate to the material and assist in your teaching.
