- The members of the judicial branch such as the judges and justices must be nominated by the executive branch and approved by the legislative branch.
- The U.S Supreme Court which belongs in the judicial branch has the judicial review power to invalidate legislation enacted by Congress. The actions of the other two branches are subject to review by the judicial branch.
- The legislative branch has the ability to balance against the powers of the judicial branch. Although the members of the judicial branch can serve for the whole of their life time, the legislative branch can remove the members of the judicial branch through the impeachment process. This is how the three branches check and balance the power of each other to prevent one branch gets too much power.

Two of the “most” important amendments to the US Constitution

- Second Amendment protects “right of the people to keep and bear arms.”
- Eighth Amendment prohibits “excessive bail,” “excessive fines,” “cruel and unusual punishments.
In my opinion, the two Amendment above is the most important amendments to the U.S Constitution for some reasons. As I am from a Communist dictatorship country, Vietnam, I understand how miserable the life under a tyranny government. And I believe that if without these two amendments, any country can impose tyranny. When people have the rights to bear arms, it's a guarantee that the government will not become the tyranny because the people have the effective weapons and they can resist. Furthermore, the Second Amendment also gives the citizens the power to defend and protect themselves. On the other hand, the Eighth Amendment works to protect the people from potentially tyranny government. I used to live in the country that it allows the police to torture the people, even in minor traffic violation cases. As a result, many people are dead in the police station. Therefore, by banning the excessive punishments, the Eight Amendment in U.S can protect the citizens from the government tyranny.

Constitutional Reform

- In order to fix issues from Constitution, at least two-third of the total states (34 states) must demand and agree on it so that Congress has to call “a convention for proposing Amendments."
- Electoral College: the totaling in number to the states combined total of senators and representatives to cast votes to decide the President and Vice-President of the United States. Therefore, the presidential candidate doesn't necessarily win the popular vote to become the President. Since the candidates can win the White House without gaining a popular majority, they may not act in favor of the majority.
- The Death Penalty: although the 8th Amendment bans cruel and unusual punishments. Therefore, the capital punishment clearly unconstitutional. However, many states in U.S still carry out the death penalty. It means that the constitution has failed to check this pathological process.
