         <description><![CDATA[<div><br>If there is a change to the placement of a child with a disability because of a violation of student conduct, the school, members of the IEP Team, and you as a parent must review relevant information in the student's file within 10 school days. All parties involved will determine if either the conduct in question was a result of the child's disability or if the conduct was a result of the school's failure to implement the IEP. If all parties involved determine BOTH of the conditions were met, the conduct must be determined to be a manifestation of the child's disability. If all parties involved determine that the conduct was  a result of the school's failure to implement the IEP, the school has to immediately remedy the deficiencies.</div>]]></description>

These services may be provided in an alternative educational environment. Student should also receive behavioral interventions, assessments and modifications to assist in the behavior not happening again. </div>]]></description>

The section I studied was the special circumstances section of the procedural safeguards. The special circumstances section states that whether a behavior was a manifestation of the students disability or not the student can be moved to an alternative educational setting for up to 45 days. The special situations that falls under this category is carrying a weapon on school grounds, knowingly has or uses illegal drugs or inflicted serious bodily injury at school or on school grounds.</div>]]></description>

         <description><![CDATA[<div>Parents/Guardians must receive notice when the school district plans to or refuses to change the identifications, evaluate, or educational placement of your child or the F.A.P.E.&nbsp;The notice must describe the action, explain why, describe what was used to make the decision by the school district. The notice must include the procedural safeguard statement and give direction for obtaining a copy, as well as resources for parents/guardians and families to use for help. The notice also must include an choices made by your child's I.E.P. team and why the choices were made. The notice must be a language the parents/guardians speak and in their native tongue and if that is not possible the school district must have it orally translated. The noticed must also be offered by email if the district offers this form of communication. The parents/guardians must be asked and give consent before an initial evaluation of the child can be conducted and they must make reasonable efforts to inform you and obtain your consent, the only time the parents/guardians consent is not required is when the child is a ward of the state. Consent from the parent must also be obtained before special education services are provided and the parents/guardians may also refuse services. Parents/Guardian permission is also required before information can be collected and before the child can be tested or studied. </div>]]></description>
