We know that article 258 of law 134 of 1994, defines us that "Voting is a right and a duty of citizens" Voting is a form of participation by society to reach a mutual agreement in order to elect the person who is going to lead at that moment. Every person has the right to vote since each one has the right to have freedom of choice, therefore, people must vote in order to avoid fraud. For this, people are mainly informed of the action plans of each candidate, since each candidate must be honest when presenting each and every one of the things that he wants to achieve for that period. They must also respect the right and decision of each person who decides to exercise their right to vote. Lastly, and in the event that there is an association, they must indicate and specify the composition of said entity, since all the information that must be submitted must be as transparent as possible. Voting is a way for society to participate in reaching mutual agreement in order to elect the person who will preside at that time. Everyone has the right. A clear example of the violation of this right, and at the same time a mechanism for citizen participation, is that of the last legislative elections. Where many Colombians denounced that when they went to exercise their right to vote, it turned out that their identifications did not appear registered in the tables arranged by the civil registry of the Republic of Colombia, to which many did register to vote for the first time. The same thing happened with those people who changed their electoral college. Even people who have traditionally voted in the same place were surprised that they couldn't vote and no solution was given to them. This event is still questioned, since the most affected have been young people. In addition to this, the web page from where you can change your polling station was down during election and registration times. Therefore, it shows that the right and mechanism of citizen participation has been strongly violated.

Bibliography: https://www.semana.com/nacion/articulo/cedulas-no-aparecen-registradas-en-puestos-de-votacion-denuncia-miguel-uribe/202224/

Students:
Jessika Arenas and Stefany Araque

What citizen participation mechanisms do you consider have been violated for the Colombian people and why?

In our opinion, we believe that the most vulnerable citizen participation has been the vote, since we can observe that this democratic act is full of ignorance, but above all of social manipulation, all this leading to a corruption that is only in favor of politicking.

But first of all we must be clear that "Colombia is a social state of law that fundamentals its political and participatory future in the people" but unfortunately the Colombian people are not very interested in making this democratic can be caused by ignorance or participatory laziness which means that Colombians delegate this task to others.

This is where the politicking and corruption of the parties comes in, the only thing they seek is their own benefit, they take advantage of the ignorance of the people to manipulate them and make them vote in their favor, but of course this is not the only one strategy that the parties use to obtain votes since there have been cases where it can be observed that the deceased were registered as active voters and that they obtained a vote for a specific party or candidate.

All this leads to a giant imbalance, furthermore, if this continues to happen, where is the power of the people?

The plebiscite is the pronouncement of the people called by the President of the Republic, by means of which he supports or rejects a certain decision of the Executive.

As a first step, Law 134 of 1994 states that "The President must immediately inform Congress of his intention to call a plebiscite, the reasons for doing so and the date on which the vote will be held, which may not be earlier than one month nor later than four months, counted from the date on which Congress receives the President's report". This request must be accompanied by the signature of all the ministers.

In Colombia all the mechanisms of participation are carried out and during the time we have been able to see how they are implemented as means through which the fundamental right to democratic participation is materialized, and allow the intervention of the citizens in the conformation, exercise and control of the political power, but the fact that they are implemented does not mean that they are complied with.

A great case where the participation mechanism of the Plebiscite was violated in Colombia, was on October 2, 2016, the NO was imposed in the plebiscite for the peace agreements with the FARC, With 99.98% of the voting tables scrutinized in the plebiscite called by the government to endorse the agreement with the FARC, the authorities indicate that 50.2% of voters opted for the No, while 49.7% opted for the Yes.

The NO won in Colombia, the initiative was not supported, there was a renegotiation of what was agreed, it was signed on September 26, 2016 in Cartagena and November 24, 2016 in Bogota in this treaty the FARC laid down their arms, they were given the opportunity to start their life in civil society and also to have a political participation in congress

From the above mentioned it can be clearly seen that the plebiscite was violated to the Colombians since even though the NO won, the process continued and ended up being given, when the people had already said NO, their reasons, the FARC did a lot of damage, they ended thousands of innocent lives, these same people have the possibility of participating in politics, these are the reasons that caused the most indignation, the people spoke and were not listened to, what they demanded was not attended to, half of the Colombian people do NOT want these people and the president did not make an agreement with them.

Reference:

BBC News World.

The participation mechanism that we consider to have been violated in the country is the vote.

This, due to the lack of control of the electoral process, causing electoral fraud, corruption and unfair practices, casts doubt on the reliability of the electoral process. In this way, they violate democracy itself.

Corruption in the electoral process occurs when certain candidates or political parties seek a benefit for their election, for this they resort to buying votes, either by offering money, some benefit, under pressure in the workplace or study and even threats. . Voters should be allowed to cast their ballots without feeling under threat of violence or under obligation to support a particular candidate or party.

Likewise, the alteration of votes is another electoral fraud that occurs, which ranges from the change in the counting record to the appearance of votes of people who have already died. This causing the votes of citizens not to be properly registered.

All this means that the mechanism of participation that the citizens of the country went out to exercise, in the end was violated and it is an event that continues to be repeated, causing the final results to be unreliable.

https://aceproject.org/main/espanol/pc/pc23.htm

Nykoll Daniela Gómez Rodriguez
Andrea Sharick Nuñez
Jheffrey David Maldonado

According to Article 103 of the Political Constitution of Colombia, the revocation of the mandate is a political right, using which citizens terminate the mandate they have conferred on a governor or mayor.
As a group, we consider that it is important to expose the inefficiency of this participation mechanism, because despite the almost 3 decades of its existence, and the 109 revocation records requested before the Registrar's Office, only one case has been effective; this occurred in Boyacá in 2017, against the mayor of the moment Nelson García. This almost always goes hand in hand with the disinterest of the people to participate in the politics of the country, or some non-compliance with the requirements that must be approved to present a recall of the mandate; because there is a belief in the country that a vote will not make a difference in the final verdict, another factor that greatly influences, is the corruption that is lived daily in Colombia, where votes are bought and sold to the highest bidder, which greatly discourages citizens to vote or to try to change the already elected officials who do not fulfill their role.

Members: Valentina Navarrete, Daniela Niño and Natalia Solano.

‌Bibliography: Su, Y., En, A., Departamento, E., Karen, D., Bustos, D., Diana, C., Castañeda, M., Universidad, L., Facultad, S., & Derecho, D.
Mechanism of citizen participation that has been violated by the Colombian people

We consider that the mechanism of citizen participation that has been violated by the Colombian people is the vote, because as established in the Constitution in Article 258, where it is mentioned that through this mechanism people over 18 years of age elect their leaders not only the president, but also the other departments that form the State and as mentioned in the same article the State will ensure that their vote is secret and without any threat or imposition on their vote. But as has been seen for many years, Colombia is a country where one of its biggest problems is corruption, we are not a loyal country to our thoughts, but we let ourselves be convinced by the opinions of others, the same candidates convince us to vote for them with lies giving us false hopes. The people do not comply with what is established in that article because many vote for a candidate being forced, threatened, imposed that they have to vote for that candidate whether they like it or not, ignoring their ideals. Sometimes the decision is very difficult because of all these factors to be able to vote freely and without any oppression because Colombia is very marked by the parties of the left, right, guerrilla, corruption and other factors that, as well as it does not allow Colombia to progress as it should be, it also does not allow its citizens to choose their rulers conscientiously. But in the same way, the same citizens are also the same responsible because they let themselves be carried away or influenced by money and they do not care about electing a good leader to improve the country, instead they prefer to elect the one who pays them the best to ensure their vote to that candidate and in this way, we will never be able to move Colombia forward if we continue failing to be loyal to our criteria and in having a vision to improve, to move forward and progress.

Bibliography

Gestor Normativo - EVA - Función Pública.

We consider that the mechanism of citizen participation that has been most violated in the people is the Vote.
First we will talk about the Vote according to article 258 of the Political Constitution of Colombia is based on the fact that it is a right and a duty of the citizen. The State shall ensure that it is exercised without any type of coercion and secretly by citizens in individual cubicles installed in each voting table without prejudice to the use of electronic or computerized means. (Political Constitution of Colombia, 1991, p154).
But despite this, through the years in Colombia we have seen that corruption rules over this, since in many occasions there is the buying and selling of votes as from the same candidates for the presidency, mayor, governor, councilors, among others, in order to win the elections regardless of the lack of transparency, there are also alterations by voters to lead to victory to the candidate of their choice. A very important issue is the way in which this right is exercised by elderly people, who normally need help to carry out this type of activities, are deceived.
It can be concluded that in spite of the arduous struggle in favor of the rights of each of the citizens, they are still being directly or indirectly violated, reaching a situation in which it is not possible to trust even those leaders to whom the wealth of the people is being entrusted. It is our duty to become aware and leave aside the individual good, which is particularly ephemeral.

Bibliography
Gestor Normativo - Función Pública. (s.f).
