The Regional Adoption Collaborative engages in a twin/multi track planning approach to family finding that seeks to ensure that if a child is to be placed for adoption, he/she is placed in his/her permanent home at the earliest appropriate opportunity. Within the current legal framework in Wales this can be achieved via parallel planning (twin tracking) or Welsh Early Permanence. Effective communication between childcare teams and the Regional Adoption Collaborative ensures that plans made are timely and avoid delay for all children with a plan of adoption. Full information is exchanged when the decision is made that the child ‘should be placed for adoption’ so that the adoption team can begin to implement appropriate family finding activities. It should be noted that in a large number of cases, proceedings will take place before the Court in respect of the child. It is likely that the social worker will have prepared statements and possibly an Interim Care Plan, which reflects that the Local Authority is engaged in twin tracking. This means that they could be considering a plan for adoption whilst at the same time, the birth parent, guardian, member of the extended family or other person with a significant connection to the child. There might be independent assessments underway, which have been commissioned by the legal representatives for the parents.

 Primary legislation

  • The Social Services and Well-being (Wales) Act 2014 revokes Part 111 Children Act 1989 in Wales. Part 6 of the 2014 Act replaces the provisions in respect of children who are looked after.

  • The CA 1989 and ACA 2002 are the same in Wales as in England, save for the reference to cultural background in the ACA welfare checklist which was removed in England but remains in Wales.

  • The Children and Families Act 2014 only applies to Wales in respect court functions.

Care proceedings are started where the local authority seeks parental responsibility, and an interim care order may be granted. Under the Public Law Outline (PLO) these proceedings should take no longer than 26 weeks. During this time, the local authority will gather evidence and analyse plans for reunification with birth parents, a kinship placement, a long-term foster placement, or adoption.
