In this Australia Case, Grant was affected by dermatitis (skin rash) after wearing a pair of underwear he had purchased. The manufacturer negligently left a chemical, metal sulphite in the materials of the underwear.

Grant had a contract with the seller, but he did not have a contract with the manufacturer, which he sued for negligence.

The court referred to the case Donoghue v. Stevenson, as with Donoghue v. Stevenson, it was not possible for the seller to see the defect, it is the manufactures fault for not having the consumer in mind when manufacturing.
