한때 세계적 석학 마이클 샌델의 ‘정의란 무엇인가’가 한국을 휩쓴 적이 있다. 당시 그의 책은 불공정과 불평등이 만연해 사회적 갈등이 심화되는 시기에 정의를 둘러싼 위대한 철학자들의 대화를 불러와 자신만의 정의를 정립할 수 있도록 도왔다.

오늘날 또 다시 정의란 무엇인가가 다시금 화두다. 화제작 ‘이상한 변호사 우영우’의 작중 인물인 권민우 역(주종혁)이 가져온 주제다. 작중에서 권민우는 영우의 동료이자 법무법인 한바다의 1년짜리 계약직 신입 변호사다. 그는 자폐 스펙트럼을 가진 우영우를 사회적 약자로 바라보기보다 경쟁 상대로 바라본다. 오히려 사회적 약자가 받는 혜택이 그의 권리를 침해한다고 생각한다. 그가 느끼는 불공정과 불평등이다.

#. (권민우) “우영우 변호사 페널티 받습니까. 꽤 오랜 기간 무단 결근했고 지금도 출근하지 않는 것으로 알고 있습니다. 같은 신입 변호사로 보기 불편합니다.”

그는 영우가 ‘자폐 스펙트럼 변호사’가 누군가를 변호할 수 있을지 고민하며 사표를 제출하고 상사가 이를 수리하지 않자 ‘불평등’을 제기한다.

#. “우영우가 강자예요. 이 게임은 공정하지가 않아요. 자폐인이니까. 우영우가 약자라는 거 그거 다 착각이에요.”

또한 로스쿨을 수석으로 졸업했지만 자폐 스펙트럼으로 서류에서 떨어진 영우가 대표의 빽으로 붙게 됐다는 사실을 확인하자 취업 비리 의혹을 폭로하는 글을 사내 게시판에 올린다. 그가 생각하기에 ‘불공정’한 일인 것이다.한국 헌법 제11조 제1항에는 ‘모든 국민은 법 앞에 평등하다. 누구든지 성별·종교 또는 사회적 신분에 의하여 정치적·경제적·사회적·문화적 생활의 모든 영역에 있어서 차별을 받지 아니한다’라고 규정하고 있다.

금성출판사가 펴낸 교과서에 따르면 ‘평등’은 기회의 균등 및 법 앞의 평등을 의미하는 형식적 평등과 개인의 차이를 인정하고 이를 좁히기 위해 적극적으로 배려하는 실질적 평등으로 구분할 수 있다.

평등사상은 기회의 평등에서 출발했다. ‘기회의 평등’은 능력에 따라 자유롭게 경쟁할 수 있도록 모든 사람에게 똑같은 기회를 준다는 의미다. 이것을 ‘형식적 평등’이라고 한다. 즉, 형식적 평등은 개인에게 주어진 선천적·후천적 차이를 고려하지 않고 동등하게 대우하는 것으로, 절대적 평등이라고도 한다. 이는 기본적 인권이나 선거권 등에 적용된다.

하지만 기회와 경쟁의 전제가 되는 사회·경제적 조건에 커다란 차이가 존재한다면 그 조건이 열악한 사람들에게 기회의 평등은 진정한 평등이라고 할 수 없다. 그래서 현대 복지 국가에서는 ‘실질적 평등’을 강조한다. 이는 개인에게 선천적·후천적 차이가 존재하기 때문에 개개인의 차이와 능력에 따른 상대적이고 비례적인 평등이 필요하다는 것이다.

The reason for the above problem is that the perception that the disabled should also have full suffrage has not been established for non-disabled people. Under the current Public Official Election Act, election candidates in all fields are not required to write Braille-type publications or display QR codes in a booklet. This is direct cause of the lack of access to voting by the disabled, and it is based on the fact that non-disabled people did not look at suffrage from the perspective of the blind.

정부가 대기업을 지원하면 물가가 오를 수 있다. 예를 들면 이명박 정부 때 중소기업이 아닌 대기업을 지원해 주어 물가가 올라갔다고 한다. 중소기업을 지원해 주면 그곳에서 일하는 직원들의 월급도 올라가고 중소기업이 성장하여 외국에 수출을 더욱 많이 하면 우리나라의 외화도 많아 지게 될 것이라고 예상한다.
