However, if the refugees are still on the sea they are not on Italian territory yet, so legally Italy is not responsible yet, therefore they do not want them to land on Italy's shores.

The reasoning by the nationalist Italian party (League) for these implementations is based on national security. It seems that the law is being followed better 
when it comes to the children on the boats, although not all children have been rescued, just the ones with serious health risks.

Enacting local Italian laws for example for fining the migrant boats for entering Italian waters seems to be in conflict the international legal framework, composing of refugee laws for example.

They seem to hold their own domestic law in higher value than international human rights law.
