         <description><![CDATA[<div>1)<strong> Laws and regulations on e-commerce</strong><br>This measurement wll help the e-commerse in Kyrgystan to be more developed as the law and regulations will&nbsp; make it legal. This will also help to protect the consumer's rights. Besides, the regulations can create a favourable conditions for the e-commerse and will allow electronic transactions which is very convenient.&nbsp; <br><strong>2) Payment system</strong><br>To develop e-commerce, it is necessary for payment systems to provide systems of automatic acquiring funds from Internet resources and mobile applications. as of today, the vast majority of banks have no acquiring systems or are at a primitive level. The process of order payment verification through the acquiring system Visa of one of the banks takes 1-3, on weekends, the waiting time increases to 2-4 calendar days. 35% of international Visa transactions are rejected by the bank. Banks do not have internal systems of automatic control and risk control to ensure that online purchases are made instantly. State portals do not have the option to pay with available mobile and bank wallets in the Kyrgyz Republic, which limits the use of payment systems.<br><br></div><div><br><br><br><br></div>]]></description>

         <description><![CDATA[<div>1) Logistics in e-commerce and technology for tracking<br>The main operator of postal services in the country, Kyrgyz Pochtasy, for unknown reasons, is indifferent to modern trends in the economy, to global market changes and, most surprisingly, to the opportunity to make money. <br><br>While colleagues in other countries are reaching new levels of income and capitalization, Kyrgyz Pochtasy, like 50-60 years ago, earns from the delivery of pensions and benefits. This is the main item of income (58.8%) in the company's budget. Although revenues from this item are getting smaller every year, the company is not looking for new sources of income. <br>2 ) Kyrgyzstan, there is no legislative platform for defining e-commerce, its types, classification of participants, the difference between different types of platforms and participants, methods of transferring, exchanging and storing data, types of technologies used.<br>Market participants are based on the existing provisions of other regulations, provisions and the Civil Code.&nbsp; However, the existing provisions are not sufficient for the active development of e-commerce.&nbsp; In this connection, there is a need to formulate and adopt a bill on e-commerce.<br><strong>3.Legislative platform for defining e-commerce in Kyrgyzstan</strong><br><br></div>]]></description>

         <description><![CDATA[<div><strong>1.</strong> <strong>Development of payment systems</strong></div><div><br>We strongly believe that this measurement has to be improved in order to help e-commerce develop further. First of all, it brings transparency to the businesses’ financial activities, thus adding more into the tax funds of Kyrgyz Republic. While Kyrgyz Republic government does not stimulate online payments, which is beneficial for the country in many ways, it might lose potential profits from the e-commerce business sector. This approach should be however cautiously researched, especially when it comes to the income taxes or commissions that have to be attractive for businesses and yet reasonable for the taxation agencies.</div><div><br>Another point we would like to underline is the opportunity for the citizens to purchase goods and services with higher comfortability, which is absolutely important for the businesses. Today, businesses sell not only goods but services with these goods. The more convenient and easy for customers to make a purchase, the more competitive the business is. Also, by providing such additional services as web-site, online payment, shipping and etc., the more job places are created and customer service level grows as a whole.&nbsp; We also think that tourists would more probably like to make online purchases or use their cards, rather than carrying a pile of cash, which for safety reasons might not be the best option. Hence we would go beyond the customer service at local citizens level, being more attractive for foreign travelers.<br><br><strong>2. Poor development of logistics<br></strong><br>I would like to talk about the importance of logistics for the distribution of products of distributors and sellers of final physical products through e-commerce.<br><br>Unfortunately, there are no logistics services in the Kyrgyz Republic for domestic sellers who would like to export their goods to near and far abroad. Logistics companies, like the state-owned enterprise Kyrgyzpost, do not provide systems for tracking the status of goods. Moreover, local and regional logistics systems do not provide the ability to automatically calculate the cost of delivery through the API.<br><br>This fact is aggravated by the fact that domestic companies do not have information systems for automatic data exchange in the field of e-commerce. For example accounting and logistics accounting, resource, and procurement management systems. Accordingly, it does not have systems for product standardization.<br><br>One of the reasons for this is the fact that there is no unified state system of address data in Kyrgyzstan. This fact does not allow to make logistic calculations necessary to calculate the cost of delivery and ensure delivery to the final buyer.<br><br>In this way, all the facts just listed regarding logistics and its poor development have a negative effect on promoting the sale of products through e-commerce.</div><div><br></div>]]></description>

         <description><![CDATA[<div><strong>1) Unification of personal data</strong><br>The electronic commerce constantly goes in line with the collection and storage of the customers' personal data. The maintainance of a database, taking advantage over data for the purpose of targeting the advertisement and other means of implementation are developing rapidly not only in Kyrgyzstan, but in the worldwide level.<br>on the basis of the Decree on amending the Decree of the President of the Kyrgyz Republic "On the Cabinet of Ministers of the Kyrgyz Republic" dated May 5, 2021, the authorized state body State Agency for the Protection of Personal Data was established. However, the agency has not started functioning yet, neither it has a stable legal basis. <br>Thus, there is no stable legislation which governs personal data usage, and subsequently, no governmental control in this matter. On the other hand, this loophole issue is directly affecting the e-commerce development, in which the storage of a personal data forms a constituent part.<br><strong>2) Consumers' rights protection </strong><br>The Kyrgyz legislation highly protects the consumers and puts the sellers into inferior position. In addition, the Antimonopoly agency is empowered to issue the warning to the sellers concerning the violation of consumers rights.<br>The legal base for the protection is the law of the Kyrgyz Republic "On consumers' rights protection" dated 5 december 1997 No.90. However, the law requires amendements since it does not include strict and defined substantial and procedural aspects of the consumers' protection implementation in the area of e-commerce.&nbsp;<br>In this regard, the rights and freedoms are not completely protected, which inhibits its  development within the KKyrgyz Republic</div>]]></description>

         <description><![CDATA[<div>1. <strong>The level of trust </strong>- This point is very relevant and important for the development of online e-commerce in Kyrgyzstan, as people often trust online sellers less. It is also important to develop a set of measures to protect personal data in order to increase the level of trust. Using online trading platforms, users must be sure that their data is protected, that they are buying from bona fide sellers. It is also possible to implement the issuance of trust signs to sites and sellers in such trading platforms. When assigning digital reputation to sellers, buyers will approach online purchases with a higher level of trust. Such methods stimulate a good attitude to e-commerce, which in turn helps to develop it and increase the number of people using e-commerce<br>2.<strong>Development of payment systems<br></strong>Using an electronic payment system in E-commerce allows customers to get instant notifications on whether a transaction has been complete and when they receive the products<br>Electronic payment system are highly expensive because it includes set up cost, machine cost, management cost etc. and this mode of payment will take more time than the physical mode of payment. All new bank cards by default blocked for online payments. In order to restore the card for online purchases, you must write an application and personally receive it at the bank, which is an important barrier to the development of online shopping<br>Commissions for Internet acquiring vary from 1.6% to 4%, depending on from business turnover, the higher the&nbsp; turnover, the lower the commission. There is a need for the adoption of a bill on e-commerce in Kyrgyz Republic.&nbsp;<br><br><br>We read the detailed publication on the e-commerce and it should be noted that currently there is no legislative platform for e-commerce in Kyrgyzstan. Market participants are based on the existing provisions of other regulations.<br>According to the reading,&nbsp; the legal basis for regulating relations in the field of e-commerce is the Constitution, the Civil Code, the Laws of the Kyrgyz Republic: “On Protection of Consumer Rights”, “On Advertising”, “On Electronic Signature”, “On Electronic Management”, “On Personal Information” , "On the payment system", "On copyright and related rights", etc. However, the existing provisions are not sufficient for the active development of e-commerce. In connection than there is a need for the adoption of a bill on e-commerce.&nbsp;<br><br>2. Lack of own powerful marketplaces hinders the development of e-commerce in Kyrgyzstan&nbsp;<br><br>We belive that Aikanysh was right about the taxation rules when Kyrgyzstan goes outside of Kyrgyzstan. From January 1 2020, in the EAEU, we are talking about 200 euros per parcel. When the goods arrive, the recipient must pay 15% of the amount that exceeds this rate. The 31 kg weight limit continues to apply. The customs clearance process varies from country to country. If online payment is provided, the customs notifies the recipient, he pays the duty on the Internet, after which the customs passes the parcel to the post office and the person receives it as usual. Some states prefer that the fee be paid directly to the post office. In Kyrgyzstan, we&nbsp; do not have appropriate way of feeing the goods in European Economic union. Kytgyzstan should work on the development of its own marketplace and not making profit for other ones.&nbsp;<br><br>3. There is a need park of e-commerce where taxes are lower.&nbsp;<br><br>High Technology Park of the Kyrgyz Republic is charging taxes for it companies less than it should be. These companies first of all are registred in Park,thus, this kind of park of e-commerce can motivate sellers to register and start their sales through the national market places. according to the interview with the presidemt of e-commerce assosiation,  in Kyrgyzstan this is less than 1% of e-commerce sales. In developed markets, the share of e-commerce reaches 20%, that is, every fifth purchase is made online. In the EAEU countries, Russia has the highest rates - 6-7%, in Kazakhstan - 2.9%. Digitalization in the economy and in trade is inevitable. It is important to take advantage of these benefits correctly and at the right time and not be left behind.</div>]]></description>
