         <description><![CDATA[<div>Within the criminal courts in the UK there are 3 types of offences, these offences categories different types of crime and decides which court the suspected individual should be sent to.          <description><![CDATA[<div><strong>Appeal process<br></strong><br></div><div>The appeal process with the criminal courts begins with a summary trial where you will be sent for trial a Magistrate court, from there you may appeal against your conviction to the crown court if you believe to not be guilty or against your sentence if you accept that you are guilty but wish to appeal for a shorter sentence. If the defence is still unhappy with the sentence from the Crown court they may still apply for a re-hearing with the Queen’s Bench Division. The prosecution and the defence may also appeal for a re-hearing to the Queen’s Bench Division (QBD) if it is on a point of law.<br><br></div><div>If the offence was deemed indictable and then sent to the Crown court, from their the defence can appeal against the sentence or the conviction on the grounds that the conviction is unsafe, whereas the prosecution can appeal if on a point of law or compelling new evidence is uncovered. <br><br></div><div>Both of these processes can also appeal to the Supreme Court, the most powerful court in the UK, if the summary offence is accepted by the QBD and the indictable offence is accepted by The Court of Appeal, the offences also must be on the grounds of general public importance to be heard.<br><br></div>]]></description>

         <description><![CDATA[<div>·         <strong>Summary Offences: </strong>These offences are minor and are sent straight to the Magistrate court, the Magistrate court has a sentencing power of up to 6 months which sounds more reasonable to minor crimes like minor assault, anti-social behaviour and vandalism.</div>]]></description>

         <description><![CDATA[<div>·         <strong>Either Way Offences: </strong>Either way offences can be categorised into either summary offences or indictable offences, the severity of the offence will determine which court the individual will go to, this is determined in a pre-trial which takes place in the Magistrate court. Offences may include theft, assault, possession of drugs and handling stolen goods.</div>]]></description>
