The Magna Carta is seen as one of the most influential legal documents in British history. It increased taxes, the king’s excommunication by Pope Innocent III in 1209 and his unsuccessful and costly attempts to regain his empire in Northern France had made John hugely unpopular with his subjects. Whilst John was able to repair his relationship with the Pope in 1213, his failed attempt to defeat Phillip II of France in 1214 and his unpopular fiscal strategies led to a barons’ rebellion in 1215. As a result, the barons focused their attack on John’s oppressive rule, arguing that he was not adhering to the Charter of Liberties. This charter was a written proclamation issued by John’s ancestor Henry I when he took the throne in 1100, which sought to bind the King to certain laws regarding the treatment of church officials and nobles and was in many ways a precursor to the Magna Carta.

The Rule of law

In 1945, the United Nations Organization (UNO) was established with three pillars: international peace and security, human rights, and development. As the world undergoes complex political, social, and economic transformations, the challenges and opportunities necessitate a collective global response. This response should be guided by the rule of law, essential for fair societies and equitable state relations. For the UNO, the rule of law means that all entities, including the State, adhere to publicly promulgated laws and international human rights standards. It requires measures to ensure law's supremacy, equal and fair application, and transparency. The rule of law is crucial for international peace, political stability, economic and social progress, and safeguarding rights and freedoms. It serves as a deterrent to corruption and power abuse, representing the social contract between citizens and the State. Aligned with the 2030 Agenda and Sustainable Development Goals (SDGs), societies based on the rule of law are a key objective for development.

The principles of the rule of law – equality, equity, inclusion, rights, laws and strong institutions – are embedded throughout the United Nations 2030 Agenda for Sustainable Development, and especially Sustainable Development Goal (SDG) 16, which aims to promote peaceful and inclusive societies for sustainable development, provide access to justice for all and build effective, accountable and inclusive institutions at all levels. The rule of law is relevant to all three dimensions of sustainable development: economic, social and environmental. By providing stable and transparent legal regimes, the rule of law encourages economic development. By ensuring equal opportunity and equitable access to basic services, it promotes social development. By strengthening the laws to protect the environment and ensure proper management of natural resources, it ensures environmental sustainability.
