Again, I don't believe any guidelines comply. This example is not specific enough to know. If the teacher took poems that were 250 words or less, than that would comply. Having her put it on itslearning though, I think violates this. The rules state the poems can be distributed one copy per student and only incorporated in multimedia, not being posted online.

It's hard to say if any of this instruction complies with the Guidelines as we don't have any details about the poems being used.

Only 250 words of a poem can be copied, so if the poem is relatively short, the entire poem can be copied. If, however, you're dealing with a poem that is longer, only an excerpt (maximum of 250 words) can be used.

Also, these poems can only be used as paper copies or incorporated into a multimedia presentation. I believe by posting to ItsLearning, this falls outside of the acceptable distribution channels.

Lastly, it says that the teacher scans "a collection" of poems, which is fairly vague. The teacher should be keeping each of these copies separate from the others, as creating an anthology does not fall within the appropriate guidelines.

In order to make this project work, the teacher should use short poems of 250 words or less or should be using short excerpts from larger works.
Regarding the distribution of the poems, they should be kept as separate files so as to not create an anthology.
If I were the teacher, I would approach the distribution in one of two ways.
1) Make paper copies and gather them back up after students use them. This is because teachers are only allowed to make nine copies of these poems per term.
2) I would link out to the poems in a multimedia presentation. If these poems are only needed for class time and students don't necessarily need to access them at home, it would be possible to link to the poems in a presentation, eliminating the need for paper copies.

I think the teacher needs to make sure he/she is not creating mini anthologies. The teacher should use fewer poems. The teacher can only make copies in 9 instances per term. I would have to do more research to know if that means 9 poems or 9 different times the teacher copied a "collection of poems" as stated in the example.

As long as the material is of 250 words or less, and it is for educational use, then it should be compliant. Although, I'd question what "anthology" indicates... because if combining and copying two or three poems = anthology, then I suppose you could do it but only if you handed them out separately.

While the poems are for educational use, the teacher is, in a sense, creating an anthology which violates the fine print rule. I wonder if a solution might to see if the poems are available in a copyrighted on-line poetry site and provide students with hyperlinks to this site for their review. In any case, all materials should be cited.
