The First Amendment

The First Amendment protects the right to express ideas through speech and the press, to assemble or gather with a group to protest or for other reasons, to ask the government to fix problems and to believe and practice religion however one chooses.

A case that set a precedent on the 1st amendment is Tinker v. Des Moines which set a precedent on allowing free speech in public schools.

The Second Amendment

The Second Amendment protects the right to keep and bear arms (aka weapons/guns).

A case that set a precedent for the 2nd amendment is McDonald v. Chicago. Which focused on how Chicago had banned guns within city limits. This case set a precedent because it overruled Chicago's decision, and ruled that states had to follow the federal law.

The Third Amendment

The Third Amendment helps aid citizens by giving them the right to deny and prevent the government from forcing homeowners to allow soldiers to use their homes.

For the 3rd amendment, the case Engblom v. Carey sets a precedent, because it extended the amendment to the national guard, and also said that it applied to states.

The Fourth Amendment

The Fourth Amendment protects citizens from the government doing unreasonable search and seizure of an individual or their private property.

A case that sets a precedent for the fourth amendment is Olmstead v. United States. This case decided that even without a warrant, police could wiretap a phone, because it didn't actually seize physical property, and there was no search of private property.

The Fifth Amendment

The Fifth Amendment provides multiple protections for the accused. First it requires a grand jury to start any serious criminal charges. It also allows for double jeopardy, which means a person to not be tried twice for the same offense and they can't have their property taken away without 'just' compensation. It also allows for people to have rights against self-incrimination and cannot be imprisoned without due process of law, which includes fair procedures and trials.

The case Miranda v. Arizona, which set a precedent for cases that focus on the 5th amendment, decided that if someone is not read their Miranda rights, if they are not advised of their constitutional rights to not self-incriminate themselves, anything they say during interrogation, can't be used against them in court.

The Sixth Amendment

The Sixth Amendment provides more protections to those accused of crimes. It provides the right to a speedy and public trial, trial by an impartial jury in criminal cases, and to be informed of criminal charges. It also says that witnesses must face the accused, and additionally the accused is allowed his or her own witnesses and lawyer representation.

The case Gideon v. Wainwright, set precedent for the 6th amendment because it ruled that, if one can't afford representation, the U.S. must provide it for them.

The Seventh Amendment

The Seventh Amendment provides, the right to a jury trial in Federal civil cases.

The case Ballew v. Georgia, set precedent for the 7th amendment, because is ruled that a jury must be made up of a minimum of six people.

The Eighth Amendment

The Eighth Amendment restricts setting bail and fines at an 'excessive' amount, and protects against cruel and unusual punishment.

The case Wilson v. Seiter, set precedent for the 8th amendment because it set the idea that the plaintiff must be able to prove that prison officials acted with deliberate indifference to his or her constitutional rights.

The Ninth Amendment

The Ninth Amendment states we have other rights not spelled out by the Constitution, and if they aren't listed, that does not mean that people do not have those rights.

The case Griswold v. Connecticut, is a case that sets precedent for the 9th amendment, because it protected the right to use contraception, because the Constitution protects marital privacy, which banning would have gone against.

The Tenth Amendment

The Tenth Amendment states that the Federal Government only has those powers which are states in the Constitution. If it isn’t listed, it belongs to the states or to the people.

The case Calder v. Bull, set precedent for the 10th amendment because it ruled that the federal government can't overturn state laws, unless it is an issue constitutionally.
