How do we as a people define justice. Without a functioning definition that the collective society sets in place, there is no way to discern whether or not justice is attainable. So, how does America as a society define justice. I, as an individual can define justice as certain way, but if America does not have to match my standard to claim justice.

However, I believe in human rights that help the minorities. The majority of people, being white people and wealthy people, are blind to the systematic inequality that the American justice system breeds. Rich white men, should not be making a decisions like they know what is best for minorities. Majorities will never know what it like to live like a minority, and therefore should not make broad generalizations for them witht the law.

If equality is looking at right and wrong strictly without any consideration for the situation behind it, there can be no justice as the human consciousness depends on differing perspectives to progress.

Considering formalism, equity, and the rule of law, is our American Justice System just or unjust?

The American justice system has been formed through years of social progress; historically moving along through first progress in the law from a few minds, then a change in the minds of the overall society. The american justice system overall promotes an air of justice, as otherwise we would not have attorney's trying to tell the full story with the idea of equity. In practice, however, the reality of the American Justice system is quite different.

The human consciousness depends upon looking at other's experiences in relation to your own, therefore having any majority is a dangerous idea. The American government system in general is ruled by the idea of a majority rule, while listening to the voices of the minority. However, in doing this, we sacrifice the idea of pure justice in order to keep anarchy from ruling our society.

The Issue with Rule of Law

The rule of law is set and established by a select group of people. There are no laws set in place that the group of people making and enforcing the laws have to reflect what the community looks like. So, we end up with predominantly rich white males making the laws, in which everyone abides by. Therefore, the rule of law does not reflect the values of a society as a whole, making the system of laws inherently unjust. If the rules do not reflect the ideals of a society, then it is impossible for there to be justice from the start. To build a society that is just, there must first be a foundation that is just itself. However, the values of society are fluid so, that presents a problem in itself. It would be extremely difficult to build a system of laws that allowed for changing values yet, was able to function on the day to day basis.
