         <description><![CDATA[<div>Marriage is currently defined as, ‘the voluntary union for life of one man and one woman, to the exclusion of all others’. This definition dates back to the mid 18<sup>th</sup> century; however, it is no surprise that morals and viewpoints surrounding the current definition are contentious. While some believe that marriage should solely exist between a biological man and woman, contemporary society widely accepts that a range of sexualities exist. Thus, same-sex couples should have the same right to marry whom they wish without the imposition of current laws restricting their ability to do so. This report aims to analyse opposing viewpoints before considering relevant alternatives in order to improve outcomes for same-sex couples who wish to marry in Australia. Without this, the law does not reflect the views of society and therefore, does not promote equity and justice within Australia.<br><br></div>]]></description>

         <description><![CDATA[<div>Marriage laws have been a source of contention in Australia ever since the case of Hyde v Hyde in 1866 gave a definitive requirement for such unions from the ruling of Lord Penzance. The current laws make marriage between same-sex couples illegal and any overseas same-sex couple in Australia will unfortunately not be treated as such. Both state and federal governments have both attempted to change legislation in recent years but these attempts have been unsuccessful. Marriage laws are a concurrent power in Australia meaning both the state and Commonwealth are allowed to pass legislation on this matter. Lord Penzance's ruling were suited to the times of 1866 Great Britain they are vastly different to the situation in 2016 Australia, with the laws regarding marriage requiring drastic alteration in order to uphold equity amongst Australians.</div>]]></description>

         <description><![CDATA[<div>The issue of same-sex marriage has been a controversial issue for many years in the Australian legal system. The recognised meaning of marriage in Australia is "the union of a man and a woman to the exclusion of all others, voluntarily entered into for life". This meaning has been around for years, however, excludes the marriage of two people of the same gender. Under the current law, same-sex couples are forbiden to get married. The lack of equity surrounding marriage leaves same-sex couples exluded and discriminated agaisnt and change needs to be made to ensure all are treated fairly and equally under the law. The purpose of this report is to analyse opposing viewpoints about the legalisation of same-sex marriage and make recommendation on how to imporve this issue to the Australian Law Reform Commissison.<br><br></div>]]></description>

         <description><![CDATA[<div>Marriage is a significant milestone in many relationships, formally uniting the lives of two individuals legally, economically, and emotionally. In 1866, the English case, Hyde vs Hyde led to the formation of a discriminatory marriage definition, after a man wanted to divorce his already re-married wife after leaving her. The following definition: "marriage is defined as the voluntary union of one man and one woman", blatantly rejects the acceptance of same-sex marriage. This definition sparked much debate in the community, with many attempts to allow for same-sex marriage being unsuccessful. The current definition of marriage in Australia is outdated and unjust, as the growing number of same-sex couples are refused the basic right to marry, and requires urgent reform.&nbsp;</div>]]></description>

         <description><![CDATA[<div>Marriage is the formally recognised union between a man and a woman as partners occurring between hundreds of thousands of couples each year. The contract legally binds the bride and groom uniting them legally, economically and emotionally. The specific phrasing in Australian Legislation "one man and one woman" segregates straight couples from same-sex couples, denying them the basic human right to love freely and without discrimination. Clearly this is a grievous injustice in Australian legislation and must be reformed to allow marriage between two people regardless of sexual orientation or gender identity to restore the fundamental rule of law; that all people are treated equally&nbsp;</div><div>- its a bit short&nbsp;<br><br></div>]]></description>

         <description><![CDATA[<div>Marriage is a highly controversial topic and has been for centuries. The definition of marriage was created in Hyde v Hyde (1866) and is still the same today. Marriage is defined as "the union of a man and a woman to the exclusion of all others, voluntarily entered into for life". This definition excludes all rights of LGBT couples and thus doesn't allow them to be married in Australia. The aim of this report is to provide recommendations as to how to include the rights of the LGBT community. Marriage is still between a man and a woman however viewpoints of the people are changing and it is time for the law to change with them.</div>]]></description>

         <title>In 1866, as a result of Hyde v Hyde, marriage was made an official part of the Australian law. It was made specific, however, that this right was only entitled to one man and one woman. As of current day this is still a prevalent part of Australian law. Same sex marriage is a concept that has been frequently debated within the legal community with numerous attempts to reform this outdated legislation. The amendment of 2004 and bill of 2012 are specific examples of these efforts. At current time of writing, these reforms have not been passed.
