Duty: The defendant had a duty when the plaintiff suffered negligence.
Breach: The defendant failed to provide the duty, which led to the breach of the duty.

The airbus's negligence lead to a crash landing in Halifax. This lawsuit proves all 3 elements of negligence. Duty - The pilots had a duty, to land the plane safely. Breach - the pilots miscalculated, and were 200 metres short of the runway. In this Video David Puttnam talks about the duty of care and its importance. He starts his talk, talking about the case of Donoghue v. Stevenson. In this case the plaintiff finds a snail in her drink. The duty of care was to the maker of the drink. David mentions how if the person who created this drink took the right precautions in the first place then there would not be an issue. But if that person continues to make these drinks then he will eventually get shut down. David then proceeds to talk about the duty of care in media. He says how media productions need to be honest when creating. But there also should not be a limit.
