         <description><![CDATA[<div>In 1914, Kansas City, Missouri, police officers used a hidden key to enter Fremont Weeks home without his knowledge or permission. The police found  papers which were used to incriminate him of transporting lottery tickets in the mail. This was all done with out permission or a search warrant.  Weeks petitioned the police to return his personal papers. The evidence was obtained illegally, so he was acquitted. </div>]]></description>

         <description><![CDATA[<div>The case was taken to the supreme court, where it was unanimously decided the the evidence was obtained illegally because there was no warrant. The evidence from Mr. Weeks house should not have been used in the case  because of his 4th amendment rights.  This case was the first time the <em>Exclusionary Rule</em> was used. This rule states that any evidence gathered illegally cannot be used in a trial.  </div>]]></description>

         <description><![CDATA[<div>The exclusionary rule was first used in Weeks trial. The police violated the woman's rights in the picture, just as they did Mr. Weeks. But, her lawyer is telling her this is a good thing because of the rule. This was also a good thing for Weeks because he got acquitted due to the fact that the police violated his fourth amendment rights. </div>]]></description>

This demonstrates that the fourth amendment was violated because Weeks never gave permission, his neighbor just told the police about the key. </div>]]></description>
