In order to claim fair use, one must meet all four factors of fair use.
  • FACTOR 1: Purpose and character of use. The purpose needs to be educational.
  • FACTOR 2: Nature of the copyrighted work. The nature should be factual.
  • FACTOR 3: Amount of portion used. There is no number of how much you can use, but it should be an appropriate amount, and not the whole thing. 
  • FACTOR 4: Effect of use. The use should not effect the market or the value of the copyrighted work in anyway.

Transformative use becomes really important if the case goes to the court. It is important to make sure that permission is taken before using materials. Most people are glad to grant permission for educational purposed when asked. It is important to:
  • make request in writing
  • make request well in advance of need
  • keep all copies of permissions granted
  • be specific with request
  • consult Copyright Clearance Center
  • don't be surprised if a fee is charged

There are two reasons for this:
  1. Copyright has expired. For example work that has been published before 1923 is too old and the copyright has been expired.
  2. Any work that is  created for the U.S. Government is considered public domain.
