Virginia state law, effective February, 24, 2017, provides criteria for delegation by nurses. These criteria include the delegating nurse to ensure that the delegated task can be safely and properly performed by the unlicensed staff delegated to, that the delegating nurse retains the responsibility for the care provided to the client, that the delegated task(s) are within the scope of practice of the person being delegated to, that the delegated task is communicated clearly with specific instructions to the delegatee. Additionally, the person whom the task is delegated must be identified as unlicensed to the patient by their name tag worn while giving care, and delegated tasks cannot be reassigned by the delegatee to another individual. Finally, nursing tasks shall only be delegated after an assessment has been performed on the patient (Commonwealth of Virginia, 2023).
