The legal limit of blood alcohol concentration in the United States is set at 0.08%. If you are tested and your results show anything higher than that, you could potentially be brought in by the police to sleep it off. However, drinking and driving is a whole other story. Drinking and driving is illegal, and getting booked for doing it is called a DUI (driving under the influence).
