-Have had 7 bargaining sessions thus far
-Next sessions on:
Nov. 17
Dec. 10
Dec. 16

-Both parties have presented full proposals on open articles, Sept. 13-14
-Expedited Bargaining = Expedited Organizing = Things move faster

Goals
1-Avoid frequent, large layoffs at Title 1 schools
2-Salary Increase
3-Greater District contribution to medical benefits
4-Lower caseloads for nurses
5-Eliminate combination classes
**Plus some small changes in a few other areas, mostly on streamlining procedures, which should be relatively simple to negotiate

MDEA makes sure:
District has a balanced budget
Every settlement reached is based on the district having the money
Difficulty: Getting accurate data from the District

Accurate Financial Data is Essential
-Unaudited actuals were published on 9/6
-The fiscal dept. estimated that expenses in 20-21 would be $11.3M more than revenue
-The unaudited actuals show that revenue was $41.2 M more than expenses
-The estimates were off by $52.5M
-These results brought the district's ending balance to $89M

District does not want to go back, they want to start in January. We want to retroact. MDEA has been doing their research. MDEA has asked for 12.5%, we cannot go higher than that now.

21-22
MDEA: 7.5%
MDUSD: 3%

22-23
MDEA 3.5%
MDUSD 2%

23-24
MDEA 1.5%
MDUSD 1%

Total
MDEA: 12.5%
MDUSD: 6%

Very few surrounding districts have settled so far this year. Pleasanton is proposing going on strike.

We will start negotiating in November of the final year of the contract, instead of waiting until March, for the future contract negotiations. District has agreed.

District has been prepared in the last 6 months, not wasting half days again. That being said, they took a long time to respond from 9/14 to 10/28 on salary proposal.

They brought in School Services, but MDEA doesn't trust the CBO who is the lead on the district finances.

We are down to 7 open items we are negotiating which is much better to declaring "impasse" because there's less we are unsettled on.

We will be ready to declare impasse when we as the reps have received feedback from our members that we are ready to act.

MDEA is advocating for return rights for teachers cut from their home sight.

MDEA feels that not enough people are speaking up. They don't feel that the Members are supporting the strike. We need to get better data on this. Tricia, as Cluster Lead for North Concord, is asking the Leads to give her data for their schools.

Tricia will be attending an all day Site Organizing Meeting on Friday, 11/12. This is where we will figure out our next steps in the process, declaring impasse, moving to strike, etc.

MDEA's goal is to NOT go on strike.

To amplify our voices, we need supermajority participation.

Hurdles in the process:
-Bargaining
-Declare Impasse
-Engage in Mediation
-Mediator must certify the parties to fact finding
-Fact Finding
-District Might Agree with the Panel's Recommendation
-Or might impose their last best offer
-If they impose, we have the option to strike

Striking is the Last Option if Loud Voices in Organizing Actions are not getting results
-Stressful & divisive
-No compensation during strike
-Walking picket lines and talking with parens will be important, necessary work
-Retirement income is affected, but not dramatically in most cases
-Members without permanent status cannot legally be non reelected due to participation in a strike, but proof & protection are difficult.

Current Action: Wear blue & stickers on Negotiating Days! Your participation is vital. We will be keeping track on a Google Spreadsheet that we will report back to MDEA.

We filed an unfair labor practice for very delayed data to MDEA last year. A settlement agreement in this unfair labor practice grievance has been reached. Been working for months, mediation with PERB appointed lawyer, came to terms, and we will memorialize that the district will meet our demands for information. By the end of this week, we should have that settlement agreement finalized.

District is saying they need pre-approval for additional credits to move teachers over on the payscale, and that it's been this way since 1969. They will deny anyone who turns in units now if they don't get preapproval. Members all denied that was ever true. They are unilaterally creating a change, so MDEA is going to file an unfair labor practice regarding this salary issue.

Retro correction for cash in lieu on the Nov. 10th paycheck. You will get a pay warrant for your fix for cash in lieu. Let us know if you don't get that payment. It will go back for 3 years, $684 total, if you've been taking it for 3 years. You were shortchanged $22.73 per month.
