A copyright protects original works of authorship as soon as author fixes the work in a tangible form. This prevents the work from being used by others without permission.

Examples of copyrighted works include literary articles, software, pictures, graphics, sculptures, architectural design, sound recordings, lyrics, audiovisual works, poems, plays, pantomimes, choreography and more.

Considerations for fair use include the nature of use, the type of work, the amount used, and the commercial impact. 

A teacher in an educational setting does not have a free pass to ignore copyright laws.

Ask yourself these four questions:
  • Is the use transformative? Yes=Fair Use
  • Is the work factual in nature? Yes=Fair Use
  • Is the amount of use minimal? Yes=Fair Use
  • Does the use negatively impact the copyright holder's ability to profit from the work? No=Fair Use

Creative Commons are not an alternative to copyright; they work alongside copyright and enable the creators of the work to modify copyright terms to best suit their needs.  

Pay attention to the details and restrictions of the Creative Commons status, for example whether or not a work can be adapted or must remain unchanged.

  • Teachers can use copyrighted content to present information to students in-person for educational purposes 
  • Teachers can share a link with students instead of downloading content (links are legal)
  • Teachers can use Public Domain materials (public domain materials are not protected by intellectual property laws and are always free to use)
  • Teachers can use Creative Commons materials (remember to use according to the permissions and always credit the owner)
  • Teachers can use information from U.S. Government websites
  • Teachers can use the Google "Tools" button to filter image search results by selecting "Creative Commons Licenses"
  • Teachers can share materials with students in a password protected site with limited exposure instead of on a public or personal website
  • And teachers can always ask for permission! When in doubt, ask.

  • Teachers cannot resell or use the work for their own profit
  • Always ask yourself how the original author would feel about your use of the material
