Obama Hope Poster Campaign case

In the case of the Obama Hope poster, made by street artist Shephard Fairey, the settlement between the Associated press and Fairey is an example of a copyright and bring in the question of fair use. In the dispute, photographer of the Associated Press, Mannie Garcia, who first took a photo of Obama in a pose that was later presumably utilized by Fairey, seen in Hope posters, the most famous of the promotion of the Obama Campaign in 2008, of which was unaffiliated with the campaign. Garcia wanted compensation for its use, and while Fairey claimed Fair Use, that it did not devalue the original work, and in a private dispute, there has been a split in profit.

This case is interesting in that Fair Use almost holds up as an argument to Fairey’s case, but the transformative part is not something common with illustrations concerning replicas of photographs. In my opinion, to have fully been considered its own work to avoid the possibility of copyright dispute, if Fairey had used it as a reference point, perhaps at another angle, it would hold up more sustenance to his argument of Fair Use.
